I suppose one can have anyone listed as trustee and it might have little to do with what state the trustee resides in. I could set up a trust for my kid, say, and choose a qualified person I trusted in say, CA, to oversee it even though I'm in NYS. Milstein is probably as good a temporary trustee as anyone.

My father has dementia, but we all knew something was wrong before his official diagnosis. Before his MRI on his brain, his best friend, an attorney, talked him into doing his living will and death will. BEFORE the diagnosis. He had no idea, just thought 'yeah, that's a good idea'. His best friend, like an uncle to me, knew that I as an only child would be forced to make alot of heavy decisions for him and made sure I had a living will giving me durable power of attorney. The POA picked up the minute he was diagnosed. TG though, it still makes it hard because he can carry on a conversation with people and make obscene purchases over the phone. They want to make out because he can have a conversation that he is 'in his right mind', but I throw that POA in their face with the doctor diagnosis and say "You will give a refund of $255.00 for a series of DVD's on how make money giving Seminars", my father would not, and could not do anything with it. LOL!
Court TV Jean Casaris states the Horizons house issue will not be determined until end of May.

Reminds me of a family member seeing a listing for the cutest house on sale at the height of the real estate boom - the price was fantastic.
Unfortunately, the photo was the wrong house - the price was for a shack in another neighborhood.
Despair was involved.
"I'm no lawyer" so i couldn't say for sure. But I'm betting the will will be contested on any number of grounds not the least of which is the "sound mind and body" thing and probably the "disinheritance of future children". Plus the fact that HKS didn't have the will redrawn after Dannielynn was born doesn't look good for him. And there is so much contingency in that will for HKS to change things as he sees fit. I bet it get's thrown out in court. HKS, if he's not if prison, will fight this thing for years.
Same rules apply, as to assets of the corp. The real question is, is there another corp. in existence that was set up in the Bahamas or elsewhere off shore, and how do the laws apply if so. We don't know. Many celebs and of course business people have various corps. in various places.

I think the balance of the Corp in the USA is probably close to "0" and NEW money was shifted to the Bahamas. Her basis for the Marshall case was that she was substantially bankrupt.

I'm a little behind on my reading here this morning, but I gotta tell you...I'm not comfortable AT ALL with the fact that HKS did not show up on Friday. Lots of people speculating in the media that it was because he may have had a 'deal' with Larry...well, Larry was there and if I'm right about Stearns, I know his type well...unless he had some huge reason NOT to be there, I can't imagine him not showing up when he knew Larry would. Control.
I think an arrest and the COD are imminent...does anyone have any idea where HKS and the baby really are? Hopefully they are being watched by someone.

Wonder why there are different dates of birth? A tiny discrepancy - but could there be a reason to pretend there are two separate persons in these transactions? Maybe ANS (at HK$' direction) - used her different aliases to muddy the financial/debt waters? Like grifters? To hide assets from the IRS? Bankruptcy proceedings?
Another win for HKS. I wonder why the delay? Just give him the house and get it over with. Expensive romp in the hay, huh Thompson?

Birkhead Bracing for Bahamian Victory

Larry Birkhead may be down one lawyer, but it looks like he may soon be up one daughter.
The court-embattled photographer emerged from his first paternity hearing without sound bite-ready attorney Debra Opri in the Bahamas Friday, and emerged if not officially victorious, then at least with a whiff of impending victory about him.
While Birkhead refused to comment on the inner workings of the hearing, he made his feelings about said workings more than clear.
"There were different moods for different people," he said outside the courtroom. "I'm in a happy mood but I can't speak for anyone else."
Both Birkhead, who was greeted with cheers and applause upon entering and exiting the courtroom, as has become standard fare with his public appearances, and Anna Nicole Smith's estranged mother Virgie Arthur attended the case management hearing, where lawyers for all sides updated the judge on what had progressed since their last hearing over both paternity and custody of six-month-old Dannielynn.
Howard K. Stern was not present for the proceedings, though judging by Birkhead's reaction to leaving the courtroom, it was likely a good thing.
While Birkhead refused to speak on the source of his newfound confidence, it's likely due to the fact that he requested, and, presumably, was granted that which he has been fighting for months to achieve—the order for a DNA test to once and for all prove whether he is in fact Dannielynn's father.
"I know I'm the father," he said. "It's just when will the court know. [The court will know] sooner rather than later."
Following the hearing, from which Arthur left less resolute, smileless and without speaking to reporters, Birkhead said he couldn't be happier with how the proceedings went, telling Access Hollywood that "what seems like has taken months and months in California is basically going pretty quickly here in the Bahamas."
"I feel good about that. I think good things are coming pretty soon."
Even, per Birkhead, as soon as next month.
"April will be like the greatest month of my life, I'm hoping," he told the entertainment show. "I mean, you never know. You just hope for the best and I'm pleased with what I heard today and I'll stay as long as I have to stay to get done what I need to get done."
The next thing to get done: returning to court.
Birkhead is due back in Bahamian court on Tuesday.
It's unlikely that the DNA testing would be complete by then, rather, more in keeping with the typical paternity testing process, the judge will simply use the court date to choose a DNA expert who will be responsible for carrying out the testing and confirming the results. Only after one is chosen will Birkhead be allowed to sidle up to a needle.
Another long-gestating court battle doesn't seem to be reaching as swift a conclusion.
Stern's hearing over ownership of Horizons, the Bahamian estate he and Smith lived in just prior to her Feb. 8 passing, the cause of which has still not been revealed, has been adjourned until April.
Stern will be fighting to avoid eviction from the property from South Carolina developer G. Ben Thompson, who claims the estate is his and that neither Smith nor Stern ever made good on its $900,000 mortgage.
Meanwhile, Birkhead's impending happy ending may be getting a big screen finish.
According to CNN, Smith's life story is heading for Hollywood, with a film version of the late Playboy Playmate's life already in the works and prepping to go into production as early as next month.
Nasser Entertainment producer Jack Nasser told the cable net that his company as "moving as quickly as possible" on the film, which will chronicle Smith's life from age 17 until her death this year at 39.
"It's not focused on the trash," Nasser said, adding that the film would focus instead on "the positive" aspects of Smith's life.
However, while Nasser promises a trash-free retelling, the movie won't be without its salaciousness. Casting notices call for "minor nudity" from the actress portraying Smith, as several scenes will take place in the Texas strip club in which Smith was discovered and in which she met her late husband, oil tycoon J. Howard Marshall II.
Casting on the project begins next week, though Nasser & Co. already have some competition in Hollywood.
Earlier this month, NBC confirmed that an episode of Law & Order: Criminal Intent would rip the Smith saga from the headlines to base a May sweeps episode around. Casting on that project is nearly complete, with Kristy Swanson and David Cross already on board.

Anna owns the house at 3646 - tax papers and addresses for her match up to house number 3646 - tax papers & addresses for Kris E match up to house number 3656
Last night Geraldo had on his show a video of the home that was real estate listed online as 3646 in the listings. But in Geraldo's video the house number on the front of that house clearly says 3656. - Anna's house at 3646 had white front doors not red doors like what is shown at 3656.
The real estate listings online were before the house was finished - there is no house number on the house in the listing but the realtor has it listed as 3646 - but again Geraldo video of this same house that was video taped recently shows the house number on the front of the house as 3656.
Yes it is confusing... so here are some pictures for you

The top picture is from Geraldo's show yesterday - it shows the house number as 3656 - notice the wood slats above the door and unique red doors.
Now the second picture show this same house (unique red doors and wood slats above the door - but no house number located at the front of the garage like it is in Geraldo's picture - the real estate listing says it is 3646 but the house was still under construction at that time - it common for real estate listers to get house numbers wrong in new construction areas when the houses do not have the numbers on them yet - notice the orange poly fence up in front of the house.
The 3rd picture is the back of the houses - red tiled one is the one marked 3656 in Gerado's video but in the early real estate ad it was listed as 3646 before the house numbers were put on it.
The correct address on the house would be 3656 on the red tiled house with red doors because the Geraldo video is recent and in Geraldo video the house is fully completed and the house numbers are up on the front of the house.
Also Anna's front door to her house were white... I am pulling together those front door pictures now.
But here is one... notice the half circle windows at the top of the door - look back at the half circle windows in the picture of the 2 house side by side. The white house has the half circle windows in it and the legal address for that white house is 3646 - this means that white house (3646) is Anna's.

the first picture that pops up here shows Anna at her front door greeting her rotton toothed cousin Shelly. This was the house she bought in Studio City and it sits next to 3656.
The laws of the Bahamas changed mid-2006. Not so easy to hide from the Feds or creditors any longer. IIRC the Bahama account was frozen at $113,000 to cover a pending debt.
