I just read up to page 10 on the first one and have to take a break for a while. My God, these people are wordy, aren't they?
We need to back these apellants up, and start holding their attorneys payable and accountable.
It bothers me that they walked the "vega" and didn't find bullets or blood and yet he was convinced the magic bullet came from Compeans service weapon. The parts (so far) that bothers me even more is the following exchange under cross on page 65 +
BY MS. STILLINGER:
4 Q. You told me, when we talked last week -- and I'm talking
5 about talking in court, when I was questioning you last week.
6 You told me that you just found out about the $5 million claim
7 that Mr. Aldrete-Davila filed. I think you said you found out
8 sometime around May or June. Is that right?

In addition, for the jury to believe Ramos and Compean, they have to believe that every other agent was lying.
CAVUTO: Let me ask you, sir, about the ex-Border Patrol agents, Ignacio Ramos and Jose Compean, both serving time in jail for shooting a runaway Mexican drug dealer.
Would you pardon them?
BUSH: You know, I get asked about pardons on a lot of different cases. And there's a procedure in place. And what I told members of Congress who have written me or called was to just look at the case, look at the facts in the case.
And people need to understand why these folks were sent to trial and why a jury of their peers convicted them. And that's, of course, what a president does on any pardon request.
CAVUTO: So, what are you saying?
BUSH: I'm saying, I would look at all the facts. And — but there is a process in any case for a president to make a pardon decision. In other words, there is a series of steps that are followed, so that the pardon process is, you know, a rational process.
CAVUTO: Well, they're in jail now. They're not going anywhere.
BUSH: Right. That's right.
CAVUTO: So...
BUSH: So...

CAVUTO: ... as things stand now, they will stay in jail.
BUSH: As things stand now, they will serve their sentence, right.
CAVUTO: Unless you interfere.
BUSH: Right. But what I'm trying to tell you is, is that it is — there is a series of steps that are analyzed in order for the Justice Department to make a recommendation as to whether or not a president grants a pardon.
CAVUTO: And we're not at that yet?
BUSH: No, we're not at that stage yet.

He (Cavuto) also had an excellent fast interview with John Walsh of "America's Most Wanted", ripping the system for having Compean and Ramos in General Population, and that they should be out on bail! Will post when transcript is available.

My comments. Might as well start at the beginning. Bold is my emphasis, quotes from transcript in italics.
Volume I: The Trial Delay.
This volume deals with the trial date being moved from October to February, as well as the conditions for the two agent's pre-trial detainment.
The testimony here refutes the speculation that the trial was moved to February because Davilas was involved in a capture involving drugs. Instead, the defense (Compean) is seen to have requested the postponement, for purpose of preparing for the additional charges which had been recently filed.
Ramos agreed to the postponement on the condition that he no longer have to wear an electronic tracking device, which was granted for both agents. The Prosecution agreed with both the delay, and the removal of tracking devices, as well as granting permission for Ramos to attend his sister-in-laws wedding.
We also learn that Davilas needed special surgery to repair the damage (we knew there was serious damage, saying "he was shot in the butt" downplayed the seriousness of his injury). From the transcript: The Army is willing to, and agreeable, of doing surgery to attempt to reattach the urethra, but it has to be done by a specialist. There's only a couple in the country. And this specialist is at Brooks Army Medical Center in San Antonio
The military would have experts in handling gunshot wounds, and this explains why he was taken to a military hospital.
His surgury was scheduled for October 23rd, which I presume was expected at the time to be after the close of the trial. According to the transcript, Davilas had to use a bag to drain his pee, and there is reference to him having to go to the bathroom every hour when he didn't use the bag: But he needs some recovery time, Your Honor. Because, after the surgery, he's going to be required to wear two catheters. One catheter -- right now he doesn't have to always wear the bag, because if he excuses himself once per hour, he can empty through the catheter.
I hope we can all agree that this section of the testimony can put to rest the incorrect speculation that the prosecution asked for a postponement because their witness was picked up with marijuana. It is clear Compean asked for the postponement, not the prosecution.
