An illegal immigrant has been sentenced to a 13-year jail term after pleading guilty to the rape of a 51-year-old North Bergen woman last year in James J. Braddock Park. Judge Camille M. Kenny sentenced Esbin Amadeo Garcia, 26, in state Superior Court in Jersey City after he plead guilty to aggravated sexual assault, said John Mulkeen, an assistant Hudson County prosecutor.
County sex crime investigators arrested Garcia, a laborer from Fairview, on Oct. 30, 2005. He was found in a bar at 71st Street and Bergenline Avenue in North Bergen after police traced a call he made using the victim's cell phone, officials said. Eight days earlier, authorities said, Garcia grabbed the North Bergen woman as she was walking home from work and dragged her into a wooded area of the park. He then beat, raped and robbed her, officials said.
With time served, he is first eligible for release in November 2016 - but then faces an uncertain future because of the nature of his crime and status as an illegal immigrant from Guatemala, which could result in his being deported after serving at least 85 percent of his term. Even if he remains in this country, he would be subject to Megan's Law and would have supervised parole for the rest of his life, Mulkeen said.
The defendant's attorney had asked for a 10-year sentence, but Kenny gave him the maximum sentence under the plea agreement, Mulkeen said. If he had been convicted at trial he could have received a 20-year sentence, he said.

This woman got 25 years for bludgeoning her 14 year old daughter with a shovel and hammer. It's justice as usual in New Jersey.

Thanks...I wasnt disheartened enough with just the rapist getting such a light sentence. :o)
I know for a fact its not just Jersey thats screwed up.. its a nation wide problem and it makes me sick.
