Ok - just looking for some help here. I've been trying to research pharmacy law regarding how long an RX for a legend drug is valid. I have CFR1306.22, and 1140-3.03 (6), but these for scheduled/controlled meds. What I'm trying to find is a specific citation to Fed Law regarding the life span of a non-controlled RX. We currently tell folks that the law is 1 year from the date it is written. I can find local (state level) statutes that cite that, but nothing in Federal Registry. I'm sure I'm looking in the wrong place, and I know there are Freepers out there that can help.
I take several heart meds,none of which are "scheduled",and am routinely told (in MA) that the prescriptions are good for a year after it's written.
Well the consensus of 4 Pharamcists (one who just took his law exam) is that its a 1 year RX. Although, they did hesitate...hahah!
It's probably buried in what is euphemistically referred to as "administrative law".
Well, yeah - they're one year RXs, if they're non-controlled, but I'm trying to find the CFR that says it's one year. I'm still digging - I think that Federal Regulations for this stuff should be controlled - it's putting me to sleep.
I understand! And the Pharmacist who just took his law exam said...yeah its in there somewhere...I just cant remember where...LOL!
