Call adds mystery to lacrosse case (DukeLax)

Phone use spans time of team party

In the middle of a Duke lacrosse party where a dancer said she was gang-raped for 30 minutes, a call was placed from her cell phone to a Durham escort service.

The 12:26 a.m. call to the service, Centerfold, lasted one minute, according to a copy of her cell phone bill reviewed by The News & Observer. It is unclear whether the call was a request for another job, a cry for help or something else, or even whether the accuser made the call herself.

But the accuser's phone records add some details to the chronology of the March 13 party, a drunken spring break bash that spawned a national controversy.

Neither prosecutors nor defense lawyers would discuss the phone records Tuesday. Neither the accuser nor a second dancer at the party could be reached, nor could representatives of Centerfold. Police Chief Steve Chalmers was out of town; his spokeswoman said he would not discuss the case.

Three players have been charged with first-degree rape, sexual offense and kidnapping: Reade Seligmann, 20, of Essex Fells, N.J.; Collin Finnerty, 19, of Garden City, N.Y.; and Dave Evans, 23, of Bethesda, Md. Lawyers for the players have proclaimed their clients' innocence and said no rape or sex occurred at the house at 610 N. Buchanan Blvd.

District Attorney Mike Nifong, whose handling of the case has undergone national scrutiny, has been adamant that the woman was raped at the party. Nifong has not given a precise timeline of when he thinks an assault occurred.

I need some help, and I hope someone here can remember what I cannot, or at least straighten me out.

I am certain that I read a description of the AV's cell phone somewhere that included the type and color.

Does anyone recall seeing such a description?

No lawyer worth his salt would proceed toward a criminal trial of his client in an effort to expose corruption or establish grounds for a civil suit if a viable maneuver to remove the client from criminal jeapordy is available. It would be highly unethical and would not serve justice nor the essential purpose for which the attorney was hired.

I see your point but the DA is hanging himself. I bet he prays every night CGM agrees to drop it. I'm betting she does and I'm also betting Nifong encourages her to.

As long as the AV wants to go to trial, it will go to trial and drag those who are no longer in support of such action kicking and screaming all the way. I don't think Nifong has the ability under the law to drop it, from our experience. He's got to keep his word to be the one sitting first chair for the prosecution, as well, or he loses what little credibility he has (and believe me, it's damned little).

I think he (and it sounds like the police) have passed way beyond the "time out, regroup stage". AV won't give it up, or she's going to have the book thrown at her (violation of parole; filing a false report). Then, there's the possibility of civil suits against both Nifong and AV. Nope! I think he's in for a penny, in for a pound and so is she. Sadly, so are my prayful concerns, the Seligmans, the Finnertys and the Evanses.

I'm worried most about Colin as I think this thing in D.C. smells almost as bad as the Durham case, and for him to lose heart now would be critical. He MUST STAY THE COURSE.

Actually, Nifing is the ONLY person with the ability under the law to drop the case.

As I said early on when this is said and done, all of these families will be able to stare down a nuclear arsenal and not blink an eye. As the one fellow who was sued into oblivion by the Ricco prosecutions against him, what else can they take from me? I've nothing else to lose, so I have no fear.
