Ah yes. He will not talk to the press in the future. It was good during the election because he got all that publicity which probably helped him the the most votes. But now, it's not so good. So long Nifong.

I'm glad to see Nifong realizes that commenting on a pending case is unethical (he admits such in his email). However, I do not buy for a minute that his orgy of press conferences was merely an appeal to the public for information. First of all, his claim there was no specific target is wrong, as he had about 43 specific targets at that time. Second, speaking to the lynch mob rally at NCCU had no purpose other than political. During an investigation, investigators may discuss the case in the press to a certain degree to solicit information relevant to the case from the general public. A group meeting like that at NCCU is not the general public but an advocacy group. It was a targeted political event. Thirdly, the investigation agency in this case was the Durham Police Department, not the District Attorney's Office. Any appeal for public information should have come from the DPD, not Nifong. The mere fact that the elected DA who was then campaigning for reelection chose to usurp the role of the DPD creates an almost unrebuttable appearance of political motivation. Finally, how does an interview with national news outlets further the task of getting infoprmation from the Durham public? Clearly local media would have been the best outlet for appeals for information.
I believe the 70 interviews were a breach of prosecutorial ethics and Nifong is trying to hide behind the investigator's prerogative to appeal for information. Maybe that means someone on the defense team has called him out on his breach of ethics.

It is too bad that under North Carolina law, the DA can take his own sweet time in putting up, or shutting up, leaving the accused twisting in the wind for an inordinate period of time. N.C. needs some new statutes on this, given the rogue DA's are abroad in the state.
