Early in the Duke lacrosse rape investigation, Durham District Attorney Mike Nifong, who was in a close race to keep his job, spoke about the physical and emotional trauma the alleged victim had suffered at the hands of the players. A police affidavit stated that her medical records revealed the victim had "injuries consistent with being raped and sexually assaulted vaginally and anally." But according to a motion filed by defense attorneys last week, no such physical trauma was found during her exam at Duke hospital. Quoting from the report, which was submitted to the court under seal, the motion states that the nurse—who was in training—examined the woman's entire pelvic region and noted only diffuse swelling of the vaginal walls, a condition explainable by consensual sexual activity.
Police documents indicate that the accuser had in fact engaged in such activity in the days leading up to the incident. The accuser told police that she'd had sex with her boyfriend a week before. She added that she'd also performed using a vibrator in front of a couple. (Though the timing of this incident is not specific, the clear implication is that it had happened near the time of the lacrosse party.) And, according to defense attorneys, the boyfriend's seminal fluid was found in her, suggesting she'd also had sex with him within 72 hours. Jarriel Johnson, who identified himself as the woman's driver, told police in a statement that in addition to sleeping with the accuser himself a week prior to the party, he'd taken her to several appointments at hotels in the days before.

I think he also alluded to a threatening, obscene gesture from Nifong. Seems to indicate it was more than just flipping them the bird.

To me this is just more evidence that Nifong is NOT dropping anything. I agree with those close in Durham that have said he's stuck.
The threats, why am I not surprised?
When it all comes out, I wouldn't be surprised if the threats aren't being made by Nifong only. I read a commentary on the web and they said that after talking to the defense attorneys there's another person acting unethically in the case from the prosecution's (Durham's) side.
If I'm not mistaken, Stuart Taylor, Jr. also refers to someone else (other than Nifong) that is basically violating the rights of the players.
This thing is bigger than Nifong. How else does one explain P. Baker's public comments that after checking with those involved in the investigation, he says the AV never changed her story.
It's a multi-headed monster, but Nifong is the one that is taking the Public beating, it is his reputation that is suffering, so I think that's why he is losing it.
These guys are used to operating a certain way in Durham, and, IMO, they counted on being able to operate using their usual tatics (coersion, emotional pressure, financial pressure, pressuring witnesses to comply or recant, etc).
Nifong and company underestimated the ability of the Defense team to prevent, counter, and publicize their unethical and potentially illegal tactics.
Not sure if he reads them. He needs to stop fearing the freeper and come over here and get some show prep.

Knows something? If that's true & he got put off the case, seems like he'd tell somebody. This is starting to sound like a Larry the Cable Guy routine. It's just bizarre.

Is this more evidence that Nifong isn't viewing the world clearly? I saw him laughing in court - wondering if this man doesn't really have a problem with detachment from reality.
Did you see the video clip of him speaking animatedly about SAVING DURHAM? He said and I quote:
"I am not going to allow Durham's view in the minds of the WORLD to be a bunch of lacrosse players at Duke raping a black girl from Durham"
That's more than a little grandiose, in my opinion. Hi, I'm Mike Nifong and I'm the savior of Durham. I will change the worlds view and save a black girl from Durham.
Maybe Liefong has developed the same disease Crystal has: Screaming whenever he sees white people. ^_^

Obviously Colmes knows nothing about Joe Cheshire. Joe might be afraid of someone, but it sure isn't Nifong. If this does ever get into a courtroom, Nifong will come face to face with his worst nightmare.
LB, actually my son tells me that over around the Pilot Mtn area that several wineries have been established. He spent a few days over there last year and visited a couple of them and was impressed with the quality. Also, the CA residents might be drinking "Two Buck Chuck".
