Lacrosse Scandal: The Duke Accuser—New Credibility Questions (Newsweek)

Early in the Duke lacrosse rape investigation, Durham District Attorney Mike Nifong, who was in a close race to keep his job, spoke about the physical and emotional trauma the alleged victim had suffered at the hands of the players. A police affidavit stated that her medical records revealed the victim had "injuries consistent with being raped and sexually assaulted vaginally and anally." But according to a motion filed by defense attorneys last week, no such physical trauma was found during her exam at Duke hospital. Quoting from the report, which was submitted to the court under seal, the motion states that the nurse—who was in training—examined the woman's entire pelvic region and noted only diffuse swelling of the vaginal walls, a condition explainable by consensual sexual activity.

Police documents indicate that the accuser had in fact engaged in such activity in the days leading up to the incident. The accuser told police that she'd had sex with her boyfriend a week before. She added that she'd also performed using a vibrator in front of a couple. (Though the timing of this incident is not specific, the clear implication is that it had happened near the time of the lacrosse party.) And, according to defense attorneys, the boyfriend's seminal fluid was found in her, suggesting she'd also had sex with him within 72 hours. Jarriel Johnson, who identified himself as the woman's driver, told police in a statement that in addition to sleeping with the accuser himself a week prior to the party, he'd taken her to several appointments at hotels in the days before.

Perhaps "Party" pressure would have an effect? If all elected NC Dem's and the NC Democratic Party start taking heat from Democratic voters because of the action (or non-action, as the case may be) of one of their own.... I would think that there is the chance that perssure could be brought to bear upon someone to take action. Well....I would hope so, anyway.....

I think any official elected in Durham who does anything to prevent the railroading of these guys will be looking for a new job. I'm hoping the case will be given to an old judge who is about to retire to Florida. He or she might be willing to actually look at the evidence and respond accordingly.

I remember reading about the second house early in the investigation. After the McFayden warrant was unsealed I thought that was the "second" house they were writing about.

It is interesting to read some of the old articles early in the case. Two good places are The Chroncile, which is the Duke student paper, and the NCCU forum where articles are posted with no commentary (some items are in bold). Some of the links on the NCCU forum are now dead but most of the articles are posted on the site.

What a terrible shame -- literally -- shame. I can't believe, yet I know it is true because of what our son's accuser said about wanting to stick it to a white guy, that there is this kind of evil. I wonder how they will justify that when they stand before Jesus -- guess that's not a big motivating factor.

Well, that's why I wrote to the AG. You have to give your name and address, so I'm sure he checked the voter registration rolls and realized that I'm not a Dem so I'm sure it had little effect.

Look at Robert Wellingon's affidavit.

Reade was outside already when the girls went into the bathroom. Reade called the cab from outside.

Wellington says that he went out through the back door when the girls stopped dancing and left the living room. he says he saw and heard nothing unusual when he went out the back door. He says when he got out back, Reade was already out there and had already made the 12:14 call to the cab company.

Wellington puts Reade outside earlier than I thought.

Lisa Wayne on O'Reilly is very informed on this case.

O'Reilly doesn't understand the law of course. Wayne says the defense can force her into court. Juan Williams talking about his softball interview of Pittman [aka Roberts.] But he says O'Reilly is on the mark about no witnesses or evidence.

Lisa Wayne says that Juan is wrong about the rape nazi stats and the case is a loser. O'Reilly predicts she will never make it to trial.

Juan Williams saying people cautioning about a rush against either side. Idiot O'Reilly claims Nifong has not talk.

I wouldn't go that far. She like others are missing the point of the motion on the warrant. It isn't what wasn't include in the affidavit. It was what was. She needs to go back and read the affidavit along with the motion. Himan played Judge Stevens as sucker.

Juan was Juan and O'Reilly was nothing spectacular.

I do not remember hearing anything about this 2nd house.

When RS left the party to catch his cab at the corner, he and his buddy stopped by the house (3 or 4 down if I recall) of other lax players.

They probably searched it looking for the shoe, rape jackets / hoodies, non-latex condoms and that black bag of OJ's they couldn't find ...

There is no evidence really. No DNA in her and the finger nail was found in the trash. The line up had no fillers so it is faulty. Everything else is just the statements of two "dancers", one who bipolar and has made up rape accusations before. And the other who is an convicted embezzler. Neither of them can keep their stories straight. Juan is a idiot.

Just a guess-- Juan never asked Kim about her statement that the rape allegation was a crock. I also bet he never asked Kim to comment on the accuser's statement implicating her in the rape.
