Lawyers representing one of three Duke University lacrosse players charged with rape want details about any toxicology tests performed on the accuser, asking in a motion filed Monday whether such evidence even exists.
"No such toxicology report, if it exists, was provided to the defense," wrote attorneys Kirk Osborn and Ernest Conner, referring to nearly 1,300 pages of evidence prosecutors provided to defense attorneys last week. The attorneys represent Reade Seligmann, one of three lacrosse players charged with raping a woman hired to perform as a stripper at a March 13 team party.
Seligmann's attorneys want a judge to order prosecutors to provide any reports "generated from blood, urine or other biological samples" collected from the accuser. In the motion, they cited a story published in Newsweek earlier this month that said District Attorney Mike Nifong "hinted" such tests would reveal the presence of a date-rape drug.
Authorities have said a doctor and specially trained nurse performed a physical exam on the accuser that found evidence of sexual assault. But the nurse who filled out a report on that exam indicted no toxicology tests were performed, according to the defense motion.
Nifong declined to comment.

And then the Durham race riots start? Or will it go further and trigger all-out civil war?
Has "Drivers" become slang talk for "Pimp?"
Megyn Kendall on Hannity Colmes in saying (in my words), her injuries were consistent with PMS.
The AV reported that her breasts were tender when palpated.
There were no tears, no bleeding, no abrasions.
However, this does explain why the 911 caller reported she was angry on the first call.
In fact, the other stripper is in negotiations to become the poster girl for PMS.
I think this means we'll see an uptick in News stories on Jimmy Hoffa, Katrina, Natalie Holloway, and how vegetables are good for you.
The News Corpse is moving beyond this story. It no longer portrays white men as the scum they are.
I wonder why she didn't say RS, CF or DE? hmmmmmm....
I assume this was asked for after the first DNA report showed no match with the lacrosse players.
I thought Tucker Carlson would be all over this tonight.
"In fact, the other stripper is in negotiations to become the poster girl for PMS."
Mike, what you don't know, is, PMS, in this case, means, "Premeditated Money Scam."
She wants a civil suit? $$$$ Think about it! These gals just can't be trusted. That was your first mistake....to trust their word.
Mike, you're toast!
I only saw the one story by the HeraldSun. This story is cold as it gets. The Newspapers (Print) reported every little rumor damning to these players, now the Newspapers won't touch this story.
I expect we'll hear a chorus of we are going to have to wait until trial for the truth. Or this is what court rooms are for. She deserves her day in court. All total B.S.
If these guys were minorities, Geraldo would be on TV holding a gun to his head urging the Attorney General of the United States to drive to Durham and see what he has seen. Oprah would been funding the entire Defense for the players. Every Paper would've printed Cartoons showing Nifong wearing a Hitler mustache complete SS regalia and boots.
Mike, you're toast!
;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;
I'm just waiting for the news to filter down the Morning show people and the View. When Matt and Rosie say it, it's Gospel. The news hasn't reached the people yet.
"The news hasn't reached the people yet."
It will....you'll be sorry.....goodnight! ;)
You are correct of course... I didn't realize that until I watched the H&C re-run....
thanks...
That alone is enough to give you second doubts of their innocence.
I like Geoff....he's cute!
Fieger is the only one, from the beginning of this case, to stand by the Duke guys and see through the false accusations of the "victim."
I liked Fieger for that.
All the others on the panel doubted the players' innocence.
I've only been wrong one time on this forum-- I claimed I'd made a mistake. Turned out I hadn't.

There goes the medical evidence.
I think it's time to move past examining the evidence against Nifong and Mangum and start looking into what real motivations Nifong has for proceeding with this.
Quo bono? Who benefits from Nifong continuing this case?

Houston A. Baker and Hortense Spillers; each considered a leading figure in black literary studies nationally; will be giving up endowed chairs at Duke and Cornell Universities, respectively, to take endowed slots at Vanderbilt.
I heard him, too, and I agree with you 100%. Ted has not been on the side of the players. He's been behind Nifong all along - tepidly to be sure, but pretty solidly there. Actually it saddens me a little to hear him try to make it sound as though he'd been on the right side of this all along. Ted isn't the sharpest knife in the drawer, but I always found him likeable and to be a decent sort.
