DURHAM, N.C.One of three Duke University lacrosse players charged with rape wants the case resolved in time for the next school year, his lawyer said in court yesterday. But the judge warned he will not fast-track the proceedings.
The case "is not going to jump ahead of the line and be handled any differently," Superior Court Judge Ronald L. Stephens said at a hearing for sophomore Reade Seligmann.
After the brief hearing, District Attorney Mike Nifong said he does not expect any trial to begin before next year.

Yes, in the "I'm a victim now" setting she can refuse to consent to a tox screen and a BAC. An hour or two before, when she was in custody for drunk in public and continuing through when she was in custody and taken to Duke Access for drug and/or mental health treatment, she was technically under arrest for being intoxicated (which can mean alcohol or drogs). She escaped that arrest by crying rape, became a victim, was released from police custody, and then refused to consent to tox and BAC (blood alcohol content) tests.
Would have definitely done the screening; CGM would have most definitely qualified. Dittos on #6: 6. Victim reports brief periods of memory loss.
She arrived at the hospital, hysterically shrieking she'd been raped. And the fact that she'd been first sent to a detox holding tank, and then uttered the "r" word, common-sense (seems to me) would have definitely demanded she be administered a Tox Screening.

I don't think the intoxication was an act. I think she was drunk off her butt when she got there. What would be the point of pretending to be intoxicated?

The patient has to consent to that test.
If it's not part of a standard Tox Screen (via urine sampling), then either Nifong was blowing smoke OR the "separate" date-rape test was requested and performed. If it was the latter, then it should have been included in the bundle delivered to the defense lawyers.
Has HOSPITAL or NIFONG messed up?

The form says none was done. Her vital signs would indicate if she was dying or in danger of collapse from drug overdose. Unless she went into a life-threatening crisis, they can't test her without her permission. Attendant just to sexual assault, they can't test her without her permission.
But the patient still has to consent to the tests.
I don't see how Nifong is getting away with this. It looks like he answers to no one.
She had to have gotten some advice along the yellow brick road to the Hospital SANE Nurse.
Unless of course, she'd taken the drugs herself, and didn't wish that to show up on the tests.
Unless of course, Kim gave it to her, and threatened her within an ounce of her life if she submitted to tests.

Do you think the PD scraped the floor of the Duke Boy's living room in the area where CGM spilled her drink? Can this be done? And to show that a "drug" was slipped into her cocktail on the premises?
The hospital would not divulge private medical information to a news station. This means the claim about the test came from Nifong, Mangum, the police, or someone close to Mangum, like her lying, dim-wit father.
