Yes, those phone calls around the time could tell us about CGM's supposed drugged state. She wouldn't have been gabbing on the phone if she was out of it from a drug, for example.

There is speculation it was the boyfriend. However, as I stated before, phone records might tell us where she was when the call was made.

Prosecutors play games with disclosure all the time. Don't expect Nifong to actually cooperate according to the requirements of the law. I think we're pretty well past that. He's going to have to be forced to do what he's supposed to do.

So he is either withholding key evidence, or he knew all along there was no toxicoogy report, and is therefore caught in yet another act of deceit.

Could the accuser say no to a tox screen? I don't think so. They would look for a date rape drug and/or see what her alcohol level was.

If she hadn't screamed rape, they would have put her in a cell overnight to dry out and that appears to be what was originally intended.

I still wonder if she threatened the cop with "take me in and I'll say you raped me".

It might just be that THAT is what occurred and the cop was trying to protect himself. Did she do a bait and switch??

No Tox report contained in prosecution evidence turned over to defense @ last week's hearing... the girls personality and appreciate her talent.
She has a very successful career ahead of her...no doubt.

Is there any point before a trial at which a judge can throw a case out in NC,or does it have to go to trial?

Yet Nifong alluded to a date rape drug possibility in the Newsweek piece.

When the author of that piece was being interview she said he alluded to it, and the he said "what if I had a witness who will say that CGM arrived sober had a drink or so and was then smashed. This was before Kim's interview in which she said that. Now it is quite possible that he felt that Kim's was going to be his witness. as funny as that seems now.

I think it's becoming clear that the DA assumed a drug based on the "instant intoxication" of the dancer. It's beginning to look like the intoxication was an act.

I am going on a hunch that it is the latter.

If he had something in a tox report he would have leaked it to the press by now. Remember Newsweek wrote that Nifong hinted about a date rape drug, but when pressed to be specific the writer of the article said Nifong suggested he had a witness who could say the accuser came to the party sober then was given a drink and then immediately became impaired. Of course we now know that witness is Kim. Nifong was talking about a witness to Newsweek...not a tox report, but he has allowed the suggestion to hang out there in the press that he did have a tox report. Typical weasel.

Wouldn't common sense tell the SANE nurse to do a blood draw to check for date rape drugs, considering she was reporting a rape, and a rape kit was used? How can that slip past anyone?

I'm sure they did one because there is no way they would let her go with the possibility that she was going to keel over from a drug overdose. LIABILITY

I'm sure they have a blood sample on record from Crystal's visit with the SANE person.
