If she hadn't screamed rape, they would have put her in a cell overnight to dry out and that appears to be what was originally intended.
I still wonder if she threatened the cop with "take me in and I'll say you raped me".
It might just be that THAT is what occurred and the cop was trying to protect himself. Did she do a bait and switch??
I believe in a case where she is the "victim" she has the right to refuse from what I've read.
Wouldn't common sense tell the SANE nurse to do a blood draw to check for date rape drugs, considering she was reporting a rape, and a rape kit was used? How can that slip past anyone?
Yes, in the "I'm a victim now" setting she can refuse to consent to a tox screen and a BAC. An hour or two before, when she was in custody for drunk in public and continuing through when she was in custody and taken to Duke Access for drug and/or mental health treatment, she was technically under arrest for being intoxicated (which can mean alcohol or drogs). She escaped that arrest by crying rape, became a victim, was released from police custody, and then refused to consent to tox and BAC (blood alcohol content) tests.
