I am going on a hunch that it is the latter.
If he had something in a tox report he would have leaked it to the press by now. Remember Newsweek wrote that Nifong hinted about a date rape drug, but when pressed to be specific the writer of the article said Nifong suggested he had a witness who could say the accuser came to the party sober then was given a drink and then immediately became impaired. Of course we now know that witness is Kim. Nifong was talking about a witness to Newsweek...not a tox report, but he has allowed the suggestion to hang out there in the press that he did have a tox report. Typical weasel.

"immediately"....I don't think that is possible with a drug taken orally.....absorption and distribution to the brain where it can take effect takes a long time with oral drugs, although it is very nearly "immediate" with inhaled/smoked or intravenous drugs......
