DURHAM -- A judge agreed Thursday to let the defense try to find out what information is on the cell phone of the exotic dancer who has accused three Duke lacrosse players of rape, and also ordered police to preserve their notes in the case.
The decisions came as the case of State v. Reade Seligmann saw its first day in court after weeks of sometimes stunning developments, press conferences, leaked documents and almost nonstop chatter.
With a trial likely still months away, the brief hearing was supposed to be nothing more than a chance for District Attorney Mike Nifong and defense attorney Kirk Osborn, representing one of the three Duke lacrosse players charged with first-degree rape, sexual offense and kidnapping, to settle some administrative issues.

"I think Nifong is a vengeful little prick, very unprofessional and highly unethical."
LOL! Boy, you do know how to call 'em!
"What's your point?"
Jezebelle's point is that Nifong is a vengeful little prick, very unprofessional and highly unethical.
Is THAT why she was taken to see a SANE person?....To protect the officer??
Was the Officer white/black and/or male/female???
We need to know!
I just saw in NC 10-56 was the code for intoxicted person
Here is a part of Kim's 911 call, she pretended to be just walking by the house and got insulted.
"Hi, I don't know if this is emergency or not necessarily, but I'm in Durham driving down near Duke's campus," the caller said.
Seconds into the call, the woman said she wasn't driving.
"It's right in front of 610 Buchanan St. and I saw them all come out like a big frat house and me and my black girlfriend were walking by and they called us n!#@%&," the caller said.
Here is some of the timeline I feel is pretty acurate, it may have been the hospital that first mentioned rape...I dunno.
1:33AM., First officer to arrive at the Kroger tells the dispatcher: "She's 10-56 and unconscious." The radio code 10-56 means an intoxicated person. The dispatcher asks: "You need a medic truck or are you 10-4?" The officer replies: "She's breathing, appears to be fine, she's not in distress. She's just passed out drunk."
2:00ish, Second officer arrives and takes accuser to nearby psychiatric hospital (substance-abuse center) because of her inebriated state. Officer referred to Duke University Medical Center (DUMC) Emergency Center.
2:31 a.m., Accuser arrives at DUMC emergency room.
2:45 a.m., Accuser checked into the hospital. Staff evaluation indicates possible sexual assualt. A Sexual Abuse nurse is summoned.
2:50 a.m., Durham police initiate "rape investigation". Accuser submits to 3-4 hour rape kit examination by a physician and a Forensic Sexual Assualt Nurse (SANE) at DUMC. She is likely given a battery of blood and urine tests. According to the DA, Mike Nifong, a hospital report later showed that her injuries and emotional state were consistent with having been raped.
Cheshire said in the press conference "single male source"..
:)
Is anyone watching The Abrams' Report
Is he covering Duke today?
Defense attorney Yale on the Abrams panel has been in contact with attorneys for the Lacrosse players. Says there is no smoking gun in the report, and SANE rape exam consistent with what defense has been saying.
The ever hateful Georgia Goslee still shilling, saying the defense could not possibly know yet that there is no smoking gun due to the 1200+ pages. Then says the DA only turned over exculpatory evidence.
Gets slapped down by other panelsts on that claim. NC attorney Wade corrects her, citing NC law requiring he turn over everything.
Today on Abrams, an important fact revealed in the medical report now in defense's possession was presented by Yale Galanter: Mangum specifically told the Duke nurse that condoms were not used.
1). If a rape ahainst Mangum was committed by these three boys in the way she said it happened, the DNA of at least one of them, in some form or another, would have been discovered on or in her body somewhere.
2). Nifong could not have not known this when he publicly advanced the proposition that condoms were used. Thinking back, he made this statement prior to the election.
I conclude that Nifong is a vengeful, LYING little prick, unethical and unprofessional, which is a downgrade from the assessment I gave of him last night, it not yet then being factually known that he is a damned liar, on top of the rest of his faults and inadequacies.
It's no wonder he was refusing to turn over the discovery. How many other lies that he's told about this case will come to light as the discovery becomes known?
Drunk person in public (not driving, basically on foot, or passed out on the street or in a public place).
You do know that the judge used to be Durham DA and Nifong's boss, right?
No, I think that's tow truck needed, or maybe it's disabled vehicle in the roadway - something to do with that situation, not drunk.
;>
Yep, I do. Stephens was followed by Hardin, who also became a judge. Perhaps a judgeship is what Nifong has his eye on, although I wonder if he's seeking higher political office, such as state senator or assemblyman, something like that.
Let em share a cell.
I have been listening closely to those statements and I haven't heard them rule out multiple DNA sources found in her. A single male DNA matched something found in her but was there other stuff for which there was no match?
Stephens is protecting his protege. It's disgusting all around.
So, then, there's no unidentified DNA found in or on her. There's no foreign DNA involved except her BF's. She told the SANE nurse or whomever at the hospital that condoms were not used. She stated that affirmatively, according to Galanter.
Nifong is a liar, then, and an unethical prosecutor for deliberately placing a false statement about the case into the media, and it appears nobody in the great state of North Carolina is going to do a damn thing about it.
