NEW CITY, N.Y. -- The laborer who raped and murdered a suburban housewife in her bedroom after being hired to clean a backyard deck was sentenced Monday to life in prison without chance of parole.
The sentence was imposed after the victim's husband, Daniel Nagle, said Douglas Herrera Castellanos "beat, cut, raped, sodomized and strangled the greatest love of my life and the mother of my two children."
The sentencing came on what would have been the 13th wedding anniversary for Nagle and his wife Mary.
Nagle, looking at Herrera, told him, "I hope that you wake up every single day and know that you ended your life on the same day you ended Mary's."
The father of two said he and his children had visited his wife's grave on Mother's Day, and he told the court how his 7-year-old son Chris asked, "Will we ever be OK? Will we ever be normal? Will we learn to live with only the three of us?"
Herrera was convicted last month of first-degree murder in the killing of Mary Nagle, 42, at her home in New City. A Guatemalan immigrant working for a house-painting contractor, he had been assigned to power-wash the Nagles' backyard deck.
According to trial testimony, Herrera, 30, entered the unlocked house and climbed the stairs to the master bedroom, where Nagle was changing into a tennis outfit. In an attack the medical examiner described as the worst she'd ever seen, Herrera raped, stabbed, bludgeoned and choked the fighting victim to death.
As he fled, Herrera allegedly used Nagle's cell phone to call several women, including one of her five sisters, and spoke lewdly about what had happened to her.
Herrera, whose visa expired five years ago, testified that he had partied on beer and cocaine the night before and did not remember entering the house or killing Nagle. However, he said, he did recall waking up next to her bloody body.
At the sentencing, he said, "I would do anything to change what happened. Forgive me." A weeping Daniel Nagle listened from the gallery.
The killing, in a quiet, tidy neighborhood, had exposed the danger of a common situation in the suburbs -- the wife home alone and a handyman on the scene, often with access to the house. Many area residents said they have changed their habits because of the killing.
With the state's death penalty ruled unconstitutional, the maximum sentence Herrera could get was life in prison without parole, and Rockland County District Attorney Michael Bongiornio told state Supreme Court Justice William Kelly that Herrera deserved the maximum. "I have rarely seen a case with this level of brutality and sadism," he said.
Kelly then imposed the sentence, saying he wanted to guarantee that Herrera "will never have the chance" to commit another crime.
Several of the jurors wept during the trial when they viewed grisly photos of the body as the medical examiner described the gashes, hemorrhages and mutilations Nagle suffered.
Jurors also wept when an old photo of Nagle, showing her smiling and radiant, was projected onto a screen in the courtroom after Daniel Nagle testified about seeing her body at the morgue.
They took less than four hours to convict Herrera of 15 felonies, including first-degree murder, second-degree murder, rape, robbery, burglary, engaging in a criminal sex act and aggravated criminal sex abuse.
Might the vermin have legal status under some of the proposals?

Hate to bring up the whole immigration/illegal immigrants issue, but if you think about it, this illegal immigrant issue is like a poison that spreads to every political issue out there, and imo, making it the reason/cause for many issues in the first place.
No death penalty? If this case does not cry out for the death penalty, what on earth does?

And for that, he gets a sentence that some embezzlers get.
Repeat that over and over again....beat, cut, raped, sodomized and strangled.
That's what this sub-human did to an ordinary wife and mother.
And he gets to live. And sneer, and brag, and laugh about it to the other subhumans in prison. Not even death row.

And Mr. Bush would like 60 million or so more of this kind of trash in our country.
Years ago in California, we had a case like this. A son of a landscaper (who had worked around the property with his father and thus was known to the homeowners) accompanied by a friend came back to the house and asked to make a phone call. The men attacked the couple, raped and tortured them, made them crawl around the house naked, and finally killed them - or at any rate, they thought they had, but the woman survived and was able to identify one of them. They were native born Americans, one being the son of the hard working black man who was the landscaper hired by the couple. The son had apparently gotten into "black power" stuff and thought this was the way to express it. IIRC, they did not get the death penalty because in California in those days, they couldn't (especially in a black on white crime).
My point is that his immigration status is not the important thing, but what is important is that he should have gotten the death penalty. The problem is that countries whose citizens commit capital crimes here protest vigorously against the death penalty, and are extremly uncooperative about extraditing them if they manage to make it back to their countries of origin. I think we should put lots of pressure on these countries, and if their citizens commit crimes here - regardless of their immigration status - they should be up for the death penalty just like anybody else. (That said, does NY have the death penalty?)

Here's what you do to fix the problem, Mr Bush:
Close both the mexican and Canadian borders. Build full-length, unassailable, permanent walls on both borders with lots of hi-tech detection hardware. Station 15,000 heavily-armed, National Guard Troops on the mexican border, and 15,000 on the Canadian border, with 6 months rotation. Shoot and kill all mexican drug traffickers and mexican military who violate the US Border. Go after all corporations and employers who hire illegal alien mexican/hispanic/latinos, with heavy fines and harsh jail sentences for all offenders, no political exceptions. Cut-off all social services to illegal alien mexican/hispanic/latinos. Repeal, by statute, the 14th Amendment, sanctioning "Anchor Babies". Cut-off all medical services to anyone without US Citizenship.
I don't believe that NY has the death penalty. My greater point is this.....his immigration status does count. If we had been vigilant about booting illegals, he wouldn't have been here to do this! The longest walk starts with the first step.
