Duke University police are investigating another rape allegation involving Duke students.
Apparently the accuser remembers "nothing". She was at a POT and booze party. She was zonked and had to be escorted "home". She asked the guy to put her PJ's on. Doesn't remember a thing excepting waking up and feeling violated. Examination reveals the presence of "fluids".
Will, it this time, be that the accused plays on the chess team?

If being impaired to the point of 'not being able to legally consent' is a basis for the charges, would a valid defense be that the alleged rapist was in fact "so impaired that he could not recognize her state of impairment"; and that "it is even possible that SHE took illegal advantage of HIS state of impairment"?
Or am I bing too "sexist", "insensitive", and "criminally logical"?
You are being logical. And not in conformity. YOU are trying to be fair. According to feminist theory, women cannot rape men, ipso, if there is any type of sexual activity in which both are squashed (or sober), it's the man's fault, anyway.
Is there a correlation between all of these rape allegations and those students jumping up and down during the Duke basketball games? Inquiring minds want to know.

Since she was so blotto, the guy can claim that she slipped him a kennedy (an ambien/phenergan mickey) and he was so disoriented he actually thought he was inserting his vote in the ballot box in the House chamber at the time of the alleged dirty deed.
This doesn't sound like much of a case for a prosecutor either. I'd say this one will be dropped or pled out on a minor charge.
The guy in this case is toast, however. He will never finish his degree at Duke. He will find transfer difficult. He may well deserve this result, of course. Sex with drunken women is pretty far out of bounds, even if a bunch of young men don't know it.
Parents, these cases at Duke are not that far out of the norm. College can be a fun-loving and supportive learning environment for some. Remember though:
Boys are in serious danger of running into a set of social and gender hostilities that they may not understand. They can be expelled, ostracized, flunked and mocked for their gender or their ideas or both.
Girls are under terrible social pressure to live their lives on the edge. Pregnancy, disease, assault, substance abuse, abortion and depression are normal parts of college life for women.
Cheap sex dominates the romantic scene. Males and females have little chance to develop the skills required for a serious life partnership. Fidelity and restraint are not understood or admired. Family life is belittled or pushed into a far-away, well-after-thirty future.
