Duke Rape Case Defense: Throw Out DA Nifong and Photo ID

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

Dan Abrams said on his show today that he has seen the DNA report and that the report contained DNA results that were inconclusive and possible mixtures of DNA that remain inconclusive. According to WRAL Nifong said it was the SBI who recommended further testing of the DNA.

I am sure the SBI suggested further testing after Nifong asked them what else he could do with the inconclusive results.

So, Dan did see the report Nifong says the defense is too afraid to let reporters see.
The DNA mixture under the nails that was inconclusive is the big bombshell evidence for Nifong, huh?.
That is what Nifong is alluding too in his coy responses.


I cannot wait until the test do not match any LAX player, let alone the two that were indicted.

The statement was made by a young man who was a student at UNCC. I think it was in the local newspaper during the first few days after the indictments were handed down. I'm sure the lawyers' clipping service got it.

I agree that someone should run against Nifong - they can at least point out his shortcomings, and there sure are a lot of them.

Just wondering if his hatred of Black is due to her turning down his advances? Or is it jealousy? She handled well a high profile homicide (the Michael Peterson case).

Somebody mentioned that he had been previously married. Would be interesting to hear what his ex had to say. As to him appearing confident, maybe its the support given him by Durham or maybe its drugs.
