Duke Rape Case Defense: Throw Out DA Nifong and Photo ID

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

Yes, I think it had to do with East Palo Alto having a reputation for having a higher crime rate than it actually does and Stanford taking over management of a high school there and trying to give East Palo Alto blight a face-lift with renovations, investment, and economic growth in a way that benefited the people of East Palo Alto. I don't think it was anything like what we're seeing in Durham and is more like what we see in many areas where the wealthier part of an area, through community planning and investment, undertakes to improve a blighted area. I think there was an ebonics issue that cropped up when Stanford took over management of the high school, but there was no rioting, people in the streets, Black Panthers, Al Sharpton - the usual race merchant suspects - involved, nor was it particular to an incident or specific people such as the Duke case.

The undercurrent of tension started slowly after white flight from East Palo Alto began in the late 60's and continued throughout the 70's. By the late 80's it was clear that East Palo Alto was decaying, so the blacks who lived there of course blamed the wealthier white people connected to the academia at Stanford just a few miles away. There's nothing new or unusual about that. There was some controversy about supposedly misstated crime statistics when redevelopment of blighted East Palo Alto was being considered, but that was ironed out through a lot of dialogue between East Palo Alto city leaders and various bodies within stanford and greater Palo Alto several years ago. I believe some of the redevelopment has already occurred, but I doubt if Stanford or greater Palo Alto planned to completely redevelop East Palo Alto, nor would that be desirable for the people of East Palo Alto. For one thing, gentrification would occur and the poorer blacks who live there would be driven out.

I don't think there was anything uncommon about these events. We see it in a lot of urban areas where the division between poor and black vs. white and middle-class is apparent. Whites move out as the black crime rate rises, then the blacks who remain wonder why their community turned to a piece of crap. It's easy for the blacks to focus on nearby institutions that appear to embody the white, middle-class structure that they won't work toward achieving for themselves due to their own cultural roadblocks. Nevertheless, leftwing white guilt rules the day and we continue to pour money down the same rathole, when what is really needed are the cultural changes within predominantly black communities that would allow such investment to be successful and the people of those communities become prosperous on their own merit and at least part of their own dime. "Gimme, gimme, gimme" doesn't cut it without a substantial commitment and evidence of cultural change.

You know, if she was "all beaten up" then the first officer that responded would have noted it and not said that she was just drunk. He would have been suspicious that "something" had happened to her.

My take on the reports of screaming (after doing a google search) is what was heard and reported by neighbors was the screaming done by both sides (Kim & some of the Lacrosse team members)at one another.

You can bet there was some serious screaming going on if the AV fell hard and busted her a$$, loosing all her bags and maybe even banging her head on the hand rail... which could explain her lack faculties that Kim noticed..

They had to have gone to the car in the 12:20 time frame which syncs with Bissey's version. CGM then seems coherent enough to remember her shoe, say so and get out to go back inside to retrieve it... From the 12:25 or so time frame Kim was cooling her heels in the car?

Kim had to go back and get her or see her on the ground and no telling how much screaming she does when she sees all CGM's stuff scattered on the ground and them boys just standing around giggling at her...

When they get back in the car she's still yelling according to the cabbie.. after 12:41 is when Kim says she notices how messed up CGM is... From the fall? From the booze? or From the DRD...???

The mammoth social welfare entitlement programs that streamed out of Washington did more damage to the fabric of our society than any number of Vietnams could have done. The irony is, that the segment of our society that it meant to help, was the one that was most grievously harmed. Of all those who fell victim to the welfare mentality, none suffered more than the black communities.

In the fifties, although blacks were still struggling for equal opportunities and were on the low end of the economic ladder, the black family was for the most part strong and stable. Two parent families were the rule, not the exception. They attended church together, had strong moral values, and did not comprise a majority of the prison population.

Compare that to the present state of the black community after 40 years of Liberal Socialism. Our prisons are disproportionably black, unwed mothers and single parent families are the rule, black youths without a strong male role model other than rap stars and basketball players, roam the streets and are drawn into a culture of drugs and crime.

The following statistics are provided by Star Parker's Coalition of Urban Renewal, (CURE).

*60 percent of black children grow up in fatherless homes.

*800,000 black men are in jail or prison.

*70 percent of black babies are born to unwed mothers.

*Over 300,000 black babies are aborted annually.

*50 percent of new AIDS cases are in the black community.

*Almost half of young black men in America's cities are neither working nor in school. What we have here is a ticking time bomb waiting to explode.

What was the message of the social programs that came out of LBJ's Great Society? One of the most devestating to the family was that if an unwed woman became pregnant, moved out of the home of her parents, did not name or know who the father was, then Big Daddy in Washington would provide for all her essential needs.

Ergo she no longer needed a husband or the support of her family. In fact, the more children she had out of wedlock, the more money she would receive from the government.

This program was the death knell for many families, especially in the black community.

Question to all: Has anyone heard Kim Roberts state in her interview/s that the complaining witness was badly beaten, bruised, swollen? Did Kim Roberts ever state that the complaining witness appeared to be in disarray once the complaining witness exited the bathroom?

I don't have a link at my fingertips (I will b4 the nite's over tho)... but the AV was on her way to the drunk tank when a female officer decided to take her to the crisis center.. If I'm not mistaken that's where the BF picked her up and transported her to the hospital...

The only thing I have heard concerning your question was Kim Roberts' lawyer saying that Kim wouldn't necessarily notice any bruising or swelling at first since those things don't show up right away. It might have been in the Rita interview before we knew who the second dancer was or I might have read it. I can't remember.

Star Parker is always right on target. She came up through the exact culture she describes. She is not a leftwing white guilt promoter speaking from the outside looking in. She knows exactly what she's talking about.

I would add to Star's points the fact that in the inner cities and predominantly black suburbs, showing an interest in becoming educated is considered to be "acting white", and that successful blacks, except the race merchants, are considered to be "Uncle Toms" and traitors to their race for embracing whitey's prescriptions for achieving success.
