2nd DNA results out until May 15

DURHAM -- Results from the second round of DNA tests in connection with the Duke lacrosse rape investigation will not likely be available before May 15, District Attorney Mike Nifong said Saturday.

Nifong also denied an allegation by some defense attorneys that the second exotic dancer at the March 13 party where the rape allegedly occurred received special treatment from Nifong's office so she'd cooperate with the prosecutor.

Kim Roberts, 31, was arrested March 22 -- eight days after the lacrosse party -- on a probation violation from a 2001 conviction for embezzling $25,000.

The same day a grand jury indicted lacrosse players Reade Seligmann and Collin Finnerty, a judge agreed to a change so that Roberts would no longer have to pay a 15 percent fee to a bonding agent. Nifong signed a document saying he would not oppose the change.

Soon after the rape allegation was made, Roberts told defense attorneys that she doubted the story of her colleague who told police she was dragged into a bathroom and raped. But in an interview last week with the Associated Press, Roberts said she thinks some players -- she's not sure which ones -- are guilty.

"It seems she is receiving very favorable financial treatment [from prosecutors] for what she is now saying," said Bill Thomas, a defense attorney for one of the lacrosse players who has not been indicted.

Nifong said Saturday that wasn't his motive in agreeing to change Roberts' bond from secured to unsecured.

"It's consistent with local bonding policy," Nifong said, when asked why he supported the change.

Nifong, who faces two challengers in the May 2 Democratic primary, attended a meet-and-greet with supporters Saturday at Joe & Jo's Downtown Restaurant and Pub, where he fielded a few questions from The Herald-Sun.

Nifong ordered the second round of DNA tests from a private lab after initial tests by the SBI crime lab in Raleigh failed to find DNA from any of 46 lacrosse players tested on or in the accuser, nor any of her DNA in the bathroom in which she said she was raped, sodomized, beaten and strangled for 30 minutes by three men.

Some defense attorneys had said they expected the new DNA test results last week.

So since Nifong has decided that the SBI lab was just too inept to give him what he wanted from the previous DNA samples, he didn't trust them to run the new tests? Very interesting.

LabCorp is running the same tests the state lab ran; if there are hair tests being done, I don't know how is doing them.

So Nifong thinks he has DNA. The only news in this long article, other than to confirm his political reasons for everything.

No, where did you hear that?

Besides it doesn't matter; the time stay on the memory chip in the camera, no matter what you do to them when you unload them.

I Googled it and can't really find much on it that I can understand, which isn't saying much.

Oh, we can be certain that he has DNA. It just doesn't match what they were hoping to. I still say they should test the DNA of the boyfriend/pimp, Kim Roberts and anyone else that was in the presence of the accuser that night. Even the cop who transported her...

I think he's trying to get a better match; if that's where the DNA came from, he didn't get a match last time; "inconclusive" in this case means "Didn't match." That's Nifong-speak.

I know this is Slate, but the program does exist. Of course, even if someone did have the program, it would have to be proven that dates were manipulated.

Maybe the DNA doesn't match, because it's not from ANY of the Lacrosse players. They all had to submit samples.

It's obviously from the real perp....if there is one!!

I didn't realize that LabCorp was testing the same DNA that was tested by the SBI lab.

If LabCorp results are the same as the SBI lab, ol' Nifong will probably just try another lab, and another and another.......this clown needs to be defunded.

Golly, why would you need a program like that?

And doesn't one of the pictures have a watch in it that verifies the time?

Dan Abrams has meet the forensic expert who authenticated the photos; don't you think they checked for that? (Of course, in this case, who knows.)

Sorry I don't believe this. I think someone is playing with the evidence...shame on them. I suspect it's already there and it shows nothing as the first DNA evidence did. This DA needs to keep this going until the election happens.

LOL! I can see football players and baseball players maybe partaking of Skoal, but somehow its hard to envision the elite of Lacrossedom indulging in that particular vice.
