CBS News correspondent Trish Regan reports that defense sources say Finnerty was eating at a Mexican restaurant when the alleged rape is said to have occurred. And they say Seligmann may not have been in the house during most of the time the alleged rape was carried out.
According to a neighbor's testimony, the stripper arrived at the house around 11:50 p.m., although the prosecution may argue she arrived earlier.
The defense says it has time-stamped photos of the stripper. The first was taken at midnight, followed by a series of pictures over the next four minutes that show her and Roberts.
There is a time gap in the photos of the alleged victim between 12:03:57 and 12:30:12, when she's seen at the back entrance of the house and appears to be leaving. A neighbor said he believes he saw her in the front yard sometime between 12:20 and 12:30.
Based on the time-stamps, there is a 16- to 26-minute window in which she could have been assaulted. But, during most of that time, Seligmann may not have been in the house.
Sources for the defense tell CBS News that cell phone records show Seligmann made calls at 12:07, 12:09 and 12:11. At 12:14, he called a cab to pick him up. Driver Moez Mostafar says he got that call and showed CBS News his dispatch records to prove it. He says he picked up Seligmann at 12:19.
"He looked normal, nothing looked unusual to me," Mostafar said. "He asked me to go to Wachovia Bank where he can get some money.

Wonder what's going on in the Nifong camp... Surely he can't believe that there is anything valid about Crystal's claim of rape at this point.
(Then I remind myself of the posters at CTV who STILL believe that this creature was raped.)

She was soundly trashed by almost everybody I saw talking about her on TV today.
And without fail, almost all the talking heads, even the ones who are pro-prosecution, said she was now useless as a witness for Nifong.
Kim says something very important during her interview which AP chose to ignore. It has the potential to diminish the 27 minute rape opportunity even more. Remember the last picture was taken at 12:03 and the next picture isn't until 12:30.
The strippers apparently left the house and had to be coaxed back inside. How long did that take? 5 minutes? But then Kim says something even more revealing. The Duke players said the strippers locked themselves in the bathroom- probably when they first came back in the house. How do we know they were in the john together? During the interview, Kim says,
"The only thing I did not see was the rape because I was not in the bathroom at that particular moment"- which means they were in the bathroom together. How long were they in the bathroom together? 5 minutes? That leaves 17 minutes for the rape and totally exonerates Seligman.
Not because I'm really interested in this particular case, I'm just really enjoying watching this Dem DA make a complete and utter fool of himself.
