Breaking overnight from Chris Cummo at ABC GMA:
Case against at least one Duke defemdant unraveling fast.
Defendant Seiligman went to bank ATM while rape supposedly happening.
12:02 Time stamped photos show girl arriving. Girl leaves, comes back, call friends on cell phone does other things. 12:19 Seiligman calls cab dispatcher 12:24 Seiligman takes cab to bank miles away, uses ATM card (photos show it is him.) 12:42 after walking back to dorm, Seiligman uses security card to enter dorm. Does not leave.
Also, Seiligman was never interviewed by cops. DA seeking reelection simply took "Dancers" word that he raped her.
Can you young whippersnappers explain to us oldsters who that drug works on you? How fast? Do you stand around smiling when you have had it?

... Ya' know Nifong may have sensed two wheels coming off the wagon here, at 'line up' time. Gives new meaning to: "she identified with 100% certainly". Yeah, 100% certainly a Duke perp would emerge from a line up of only 100% Duke player photos.
The other two wheels would HAVE come off, if princess ID'd someone who was not even a Duke player.
How to win an election, if you can't go forward with an indictment?
By in effect insuring 100%, that Mangum would include a Duke player identity, he could set up an easy 'out' to claim he HAD to indict.
He has a woman who showed physical signs of sexual activity alleging rape. The black community is enraged and demands justice. Nifong, however, obviously rushed to judgment initially, but he has now stopped talking about the case. In the meantime, the alleged victim still stands by her claim, so Nifong is forced into action.
The grand jury has no choice but to indict in this instance. Now the onus is on Nifong to try the case, and if Crystal was incorrect on her "100%" ID, and if the defense has proof of them not being there at the time of the "crime", this case unravels and Nifong either has to drop it or get Crystal to change her story (AGAIN).
The end result is this. If the defense has the alibi they say they have, Crystal will be the one vilified, not Nifong. This is why presenting the "evidence" to the grand jury was actually a decent idea by Nifong.
"Not my incompetance, the woman pick them out of a lineup. What else could I do?"

Here is the relevant language from the police affidavit:
"During a search warrant at 610 N.Buchanan on 3-16-2006 the victims four red polished fingernails were recovered inside the residence consistent to her version of the attack. She claimed she was clawing at one of the suspects arms in an attempt to breathe while being strangled. During that time the nails broke off. The victims makeup bag, cellphone, and identification were also located inside the residence during the search warrant. Finally, a pile of twenty dollar bills were recovered from inside the residence totaling $160.00 consistent with the victim claiming $400.00 cash in all twenty dollar bills was taken from her purse immediately after the rape."

The police say clearly that the fingernails, makeup bag, cellphone, identification and cash were all recovered INSIDE THE RESIDENCE, not outside on the ground.
The fingernails were recovered INSIDE THE RESIDENCE CONSISTENT TO HER VERSION OF THE ATTACK which I think can only mean they were found in the bathroom where she was clawing at them, and NOT inside the makeup bag.
The other items were not necessarily in the bathroom, but they were inside the house and not in the yard, so one of the housemates clearly must have picked them up and brought them inside.
Also, it seems as if the student who put her in the car put her purse in there too, but not her makeup bag, as she says they stole cash out of her purse but not the purse itself, and there was only one bag (the makeup purse) and not two bags recovered at the house.
I have a feeling that's not going to be good enough for the defense team.
The other thing that is odd to me with this case is that in the county where I work the prosecutor's office usually does not get involved in the case until after the police investigation is complete.

Anyway, he did say that he had talked to several people who had seen the accuser before she went to the lacrosse party, and ALL said she was intoxicated.
This is outrageous. Is there any way this guy can sue for wrongful prosecution? I certainly know that the girl is a turnip, but does the DA have any exposure? This is an absolute outrage!

HENDERSON - Milton Allen Mangum, 53, of 619 Eaves Road, Henderson, in the Epsom Community died Friday, Aug. 5, 2005, at his home.
Born in Vance County, he was the son of Irene Mangum White of Henderson and the late William Lee White.
Mr. Mangum was a former employee of Burlington Industries, Inc.
A memorial service will be held today at 3 p.m. at Flowers Funeral Chapel conducted by the Rev. Leon Gupton.
Surviving, in addition to his mother, are his wife, Terry Stokes Mangum; a daughter, Christal Gail Mangum, of Raleigh; a son, John Allen Mangum, of Henderson; two stepdaughters, Jeanette Pruitt Richardson of Willow Springs and Melissa Pruitt Wilson of Henderson; a sister, Pat White Hodge of Henderson; one grandchild; and two stepgrandchildren.
The family will receive friends today at Flowers Funeral Chapel immediately following the service. All other times they will be at the home at 619 Eaves Road, Henderson.

You're absolutely right.
Now that they've been indicted and their names and family information has been made public, it is in Finnerty's and Seligmann's best interests to go to trial and be found not guilty. Otherwise, they will have this hanging over their heads for the rest of their lives. They should demand a speedy trial, as is their Constitutional right, and force Nifong into court.
But in spite of all this, if their attorneys can get the indictment thrown out, that's the way to go. They can't risk a conviction.
