A class action lawsuit has been launched against Apple Computer claiming the companys recently released diminutive iPod nano scratches too easily. The lawsuit, filed in US District Court in San Jose California, seeks to represent up to 125,000 iPod owners the law firm that launched the case said.
The suit claims that the iPod Nano is defectively designed, allowing the screen to quickly become scratched with normal use. The suit also claims that the excessive, rapid wear renders the device unusable.
The suit charges that Apple violated implied and expressed warranties when it began selling what plaintiffs claim are defective devices, and violated aspects of state consumer protection laws, the lawyers said in a statement.
The suit seeks compensation for purchasers of the devices.
Apple executives responded to consumer complaints in September regarding excessive scratching and broken screens. Apple said that the screens on the iPod nano are made with the same material that is found in the companyâs fourth-generation iPod, which, to date, is complaint free.
Apple recommended users purchase an iPod nano case to prevent scratches.
Apple representatives were not immediately available to comment for this story.

The settlement will probably be a coupon for $10 off each plaintiff's next purchase of an iPod and $12.5M to the attorneys.

Whine, whine, whine. This reminds me of the rich guy who sued an auto dealer in (I think it was) Alabama because his new Beemer had been slightly discolored in a fire, otherwise undamaged, and had been repainted.
Class action suits exist of by and for the lawyers. I got a class action "share" check of 17 cents not long ago, and I have no idea at this point what the class was, what the lawsuit was about, or who paid me the pittance.
Just proves that you should never, never, never buy the first release of any Mac product. It takes Apple a little while to get it right. But once they get it right, the results are better than ok.
What have you been smoking? iPod is not a "Mac" product. It is a product of Apple Computer. I have used quite a few new Mac iterations, and will buy some more, when they come available (though I will have to have a good reason to change from my G5, to an intel Mac).

It is pretty close, anyway. I received several invitations to join class action suits against Apple. One involved something I was horribly and grieviously misled about in OS X. The remedy was a few dollars off when I upgraded to the next version of OS X.

I've had Apples since 1984. I have 2 intel Macs right now. (I also have machines with Linux and Solaris as well as various flavors of Windows). I have G3s, G4s, G5s, MacTels, and I still have the original Mac I first bought in 1984. I have 32 bit Intels and 64 bit ones. Why would a statement that I've always found the quality of an Apple product better on its second (or third) iteration imply that I'm working for Gates? I don't drink the Apple or Windows kool-aid. I, have an independent mind. Sorry you need to type cast.
