I was just reading Article 2 of James Madison & Ben Franklin's opus magnus and started counting the number of times that masculine gender is indicated. Hmmm, I doesn't appear that Hildabeast (or "Law of the Sea" Condi for that matter) can even be president.:

A lawyer here can clear this up better than I but I think in a legal document, a pronoun cannot be a final indicator of gender specific rules unless those are specified with a clause defining them. I.E. there must be a clause that says something like "the presidential office must be held by a male who has reached the age of 36.. etc)

Actually in that era women weren't eligible for public office nor could they vote. It was more than a grammatical device.
