Appeals court strikes down ‘click-to-cancel’ rule

A federal appeals court just threw out a new government regulation that would have required subscription services to give consumers an easy way to cancel.

The Federal Trade Commission’s click-to-cancel rule was set to take effect next week, and would have required everything from your gym membership to Amazon Prime subscription to let customers cancel their recurring payments as easily as they signed up, and through the same method.

Last fall, industry groups representing companies that benefit from subscription revenue — including cable providers, entertainment studios, advertising companies, and home security firms — sought to block the rule in court, arguing the FTC aimed to “regulate consumer contracts for all companies in all industries and across all sectors of the economy.”

But in a unanimous ruling by a three-judge panel for the Eighth Circuit, the court found that the FTC under former Democratic Chair Lina Khan erred so gravely in its roll-out of the rule that it needs to be thrown out altogether. “While we certainly do not endorse the use of unfair and deceptive practices in negative option marketing, the procedural deficiencies of the Commission’s rulemaking process are fatal here,” the court wrote. Even though parts of the rule were technically salvageable, the court continued, vacating the entire rule is appropriate “because of the prejudice suffered by Petitioners as a result of the Commission’s procedural error.”

Wow, actually sounds like a worthwhile requirement. The article is short on analysis and information, like who were the 3 judges.

I agree. I’m thinking they rushed it through in the last days that the Biden Women controlled the government...without giving enough time for comments. Be really nice to see Trump revive it.

I remember once when I called Visa to cancel a recurring charge - they would not do it.

Getting ‘un-subscribed’ to these businesses is nigh impossible. They have your credit card number and will continue to bill you every month for months even after you tell them to stop. A local lady had to get a court order to make a service stop billing her card and she didn’t get a refund for the months they stole her money.................

What's amazing to me is the Dems seemingly doing something to help normal people. There has to more to this story that is not being provided.

Directv used to be the worst.

I heard an audio recording once of a customer trying to cancel.....the “customer service rep” and I used that phrase loosely here just flatly refused to terminate the subscription.

Right, you can sign up for anything at the Verizon store, but you can’t cancel anything there, you have to call India.

Like canceling many of these subscription services. Canceling a judge is a long drawn out tedious process.

I just went through canceling garbage service from waste Management at my business. It started with a certified letter actually mailed to an address of which they claim they didn’t get. So I had to send another one. Then they finally admitted they got the first one and started their 90-day clock one month after they got it because they didn’t know they had it and that’s my fault I guess. Then it takes them 90 days to actually cancel your service. Why? I don’t know probably so they could continue billing me $100 a month for a service others offered for 30. Now two weeks after the service is finally been canceled and the truck stop coming to dump their can That dumpster is still sitting in my parking lot. I’m about to push it out in the street and let the city deal with it

FR: Never Accept the Premise of Your Opponent’s Argument

I'm not up to speed with contract law, so Justice Joseph Story's explanation of the Constitution's 1.10.1, one of two mentions of this subject in Constitution, was a challenge for me.

Basically, not only do I find no express constitutional delegation of power to regulate contracts to the big, bad feds, the 10th Amendment automatically reserving such power uniquely to the states imo, but regulations many by constitutionally undefined, so-called federal regulatory agencies run by non-popularly elected bureaucrats is a constitutionally no-no, the deep state, career Congress wrongly looking the other way while these bureaucrats steal and exercise state powers.

It looks like constitutionally undefined FTC wrongly interfered with private contract.

We canceled an extra line we had with AT&t for an employee we no longer have. The wife called and it took 45 minutes. She kept saying no to everything Will give you a new phone we’ll give you a home internet would you like to sign up for home internet did you know you could get TV services. She finally said look I’m going to make this simple we don’t need the line it’s out of contract cancel it or we cancel the whole account. That seem to have got their attention

Cut cable TV not too long ago - too much content no one in the house was watching and the price had gone up to well over $100/month.

Had my son make the phone call - he has a loud booming voice and is good at cutting to the chase. Didn’t take too long, he told a couple of jokes and the agent he talked to cut the service quickly. Glad to get rid of that bill.

As far as steaming services, they’re relatively easy to end on the iPhone. Have recently cut several that no one was watching - and they’ve all increased in price.

And I also read The Eighth Circuit found that the agency skipped steps to issue the rule, including depriving stakeholders of “a notable opportunity to dissuade the FTC from adopting the Rule as proposed.”. Which leads me to believe there are defined procedures, but exactly where are these procedures defined?

And at the end of the article it states: consists of three Republican members including Ferguson and Holyoak, the future of the rule looks bleak. Why would republicans not support this rule? Could be a case of misnaming, such as "Don't say gay". Other than the ruling the article provides no pointers for follow-up, so I was hoping some FR legal eagle could provide additional insight.
