The First Circuit Court of Appeals on Tuesday (for now) sided with the Biden judge who blocked the Trump Administration from dismantling the Department of Education.
Last Thursday a federal judge blocked the Trump administration from dismantling the department of education.
In March, President Trump signed an executive order to dismantle the Department of Education.
“We’ve got to get the federal government out of education,” Trump declared. “The Department of Education has become a bloated bureaucracy that’s more interested in pushing its own agenda than in helping our kids learn. It’s time to put the power back in the hands of parents, teachers, and local communities.”
The Trump DOJ appealed Judge Joun’s injunction and the First Circuit Court of Appeals denied their request for an immediate administrative stay.
However, the appeals court said it intends to rule on the DOJ’s request for a stay pending appeal promptly.

It’s not totally being dismantled...There are parts that do nothing...It’s become another money tree.
The last thing we need in USA is a federal bureaucraZy screwing around with our schools
And those parts that do nothing are being laid off.
Keep two people, in one office, who distribute funds back to the states.
Republicans in the house need to stop taking their vacations and do Something about these courts. They hold the purse strings, use them.

Firing or lay-offs are one thing. Dismantling a Congressional created Department is another. I never saw this EO being approved.

I believe his EO was to trim it down to only those parts that are mandated by law.
We would not be having this discussion about Federal courts if the Republican Congress simply reduced the DOE budget to zero.
