The Fourth Circuit Court of Appeals denied the Trump DOJ’s effort to block Judge Xinis’ order requiring the US government to “facilitate” the return of alleged MS-13 gang member Kilmar Abrego Garcia.
A three-judge panel: Harvie Wilkinson (Reagan), Robert King (Clinton), and Stephanie Thacker (Obama) issued the order.
Judge Wilkinson, the Reagan appointee, repeatedly referred to Abrego Garcia as a “resident” even though he’s an illegal alien.
Kilmar Abrego Garcia is an El Salvadorian national who was illegally residing in Maryland. In 2019, an immigration judge ordered Abrego Garcia, an alleged member of the dangerous MS-13 gang, removed from the US.
Abrego Garcia is currently being held at El Salvador’s notorious CECOT prison.
“It is difficult in some cases to get to the very heart of the matter. But in this case, it is not hard at all. The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order. Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done,” Wilkinson wrote in a 7-page order reviewed by The Gateway Pundit.

Blocking his return is not the same as not facilitating his return. If the dude was on a plane headed here then Trump could block him. But no one can force Trump to bring him back which the court is trying to do in a feminine passive aggressive way. The headline is poorly written.
Trump should put his name on milk cartons and ask the people to be on the look out for anyone he associates with;)
People will errupt with joy when the Trump Admin lawsuits take over CBS, ABC and the rest of the liars networks, returning them to conservative news organs.

They should correct their mistake.
They were cleared to deport him - just not to El Salvador as everyone here knows.
They should notify the courts that they have corrected their mistake and transferred him directly from ElSalvador to country x as per the court’s order.
Country x then repatriates him to El Salvador. Courts should be notified after the fact.

The “judge” can try that invasion himself...and promptly get sent to hell where he belongs.

Land an expeditionary force of 20,000 Marines, occupy El Salvador, go into CECOT and extract him, dead or alive, preferably the former, bring him back here to the USA, and take him or his corpse to the judge’s courtroom and lay the body in front of the judge, three days rotting.

Right. IF El Salvador returns “Maryland Man” then according to the order the Trump must “facilitate” (allow) it. And the court can’t order El Salvador to do anything since they have NO authority down there. So.... case closed!

All judges, politicians, family, supporters of kilmar’s return should all have to sign agreement to be held liable/accountable along with kilmar for any and all crimes he commits should he be on US soil any amount of time.
Meaning they each pay any fines, show up at every court matter, basically have to shadow life him for any violation at all.
These lefty men in robes hate Trump because he was able to sail through the best efforts of their lawfare to get him. They think getting him is their red badge of courage. Doing bad will have its just rewards.
El Salvador says nope he stays.
