A California man accused of plotting to assassinate Supreme Court Justice Brett Kavanaugh in 2022 intends to plead guilty, his attorneys said Wednesday.
Nicholas John Roske, 28, of Simi Valley, California, was arrested in June 2022 near Kavanaugh’s Maryland home, armed with a handgun, a knife, and zip ties, according to federal authorities. Roske allegedly threatened to kill Kavanaugh because he was upset that the justice may overturn Roe and allow states to protect unborn babies from abortion
The arrest came shortly after the leak of a draft Supreme Court opinion indicating the court would overturn Roe v. Wade, which allowed abortions up to birth across America.
Roske’s lawyers informed prosecutors of his intent to plead guilty to attempted assassination charges, though a formal plea agreement has not yet been finalized, The Washington Post reported. The decision follows months of legal proceedings and negotiations, with a plea hearing expected in the coming weeks in U.S. District Court in Greenbelt, Maryland.
Federal officials said Roske traveled from California to the Washington, D.C., area with the intent to kill Kavanaugh, a conservative justice who later voted with the majority to overturn Roe v. Wade in the Dobbs decision. Court documents allege Roske was motivated by anger over the anticipated ruling and had researched Kavanaugh’s home address online. He was apprehended after calling 911 himself, telling dispatchers he was having suicidal thoughts and needed help.
At the time of his arrest, authorities found Roske carrying a tactical vest, ammunition, and burglary tools, suggesting a premeditated plan. He was initially charged with attempted murder of a U.S. official, a crime that carries a potential life sentence. Details of the plea deal, including any reduced charges or sentencing recommendations, remain unclear.
The exact date for Roske’s plea hearing has not been set.
Days after a leaked draft ruling showed the Supreme Court overturning Roe, the pro-abortion group Ruth Sent Us published the addresses of the conservative justices’ homes online publicly – prompting authorities to increase security for the high court members and their staff.
Justice Samuel Alito, the author of the draft opinion, and his family also were moved from their home to a secure location due to violent threats.
