How to Defeat the Courts: Real Practical Responses

Many pundits, including lawyer Robert Barnes, are harping on impeachment of these rogue judges. I think that has little, if any, hope of success.

Nor do I think defunding or changing the jurisdiction of the courts will work. We're easily 20 votes in the House and 20 votes in the Senate short of either of those options.

But Trump is winning, and can continue to win, by other means, practical means, historically time-tested means.

First understand that TIME IS ON OUR SIDE. These agencies have been closed. People have been fired. Buildings are locked up. Some are sold already. Policies are already in place. Ownership is 9/10 of the law.

The longer it takes to get something "back" or to get people re-hired, the more we win. Federal employees can't go without paychecks---even with unemployment---for long. Some will get other jobs. Some will move. With every single dropout, we win. Every dollar saved, we win.

So a judge orders grants to "green" turned back on? So what. The Secretary should already have new rules in place that, gee, now every grant must go through a re-review process of a 3-member panel, with its decisions reviewed by a 5- member panel. Sorry, that's just the process. Those reviews should take as long as Charlie Manson's parole.

New rules should require the Secretary to personally review every check on a grant and to countersign.

The "mail" needs to be really, really slow.

Think this can't be done? Look at the South's response to the Supreme Court's 1954 Brown v. Board of Education order to desegregate "with all deliberate speed." How'd that work out? Wasn't til the late 1960s this was even remotely accomplished. Give Trump a 5 year window and this criminal government apparatus is finished.

Hold up staffing requests. Whenever possible rehire with MAGA people (the old "spoils system"). In reality, some of these jobs WILL be refilled with MAGA anyway.

Require physical signatures from judges on the order in accordance with the law before you comply.

Appeal, appeal, appeal.

Change the wording of the releases and closures ever so slightly to require an all new ruling.

In short, every day that goes by that agencies are closed and not spending money makes it LESS likely they will ever recover---regardless of what Justice Johnny and the Supes say.

It’s what NYS does to stifle the 2nd Amendment.

Change two words in the Law/Rule and Shaaazaam!

Now plaintiffs (Citizens!) gotta start the court climb all over again.

These are all good ideas. 4 years of executive authority pushing hard against the bureaucracy is going to get a lot of wins.

Humphrey's Executor is going to be challenged directly at some point during Trump's Presidency, and that's the Supreme Court case that will change everything if we win. I am really concerned that some of this impeachment and other stuff is going to push swing justices towards not wanting to give more power to the President, and away from overturning that case.

The other downside of impeachment is once you go down that road, the other side will use it as well, as soon as the Democrats take control of the House, they will not only launch impeachment actions against Trump but Clarence Thomas and other conservatives on the Supreme Court.

IMO, executive actions are great, but a more permanent solution is to pass things into law, especially those things that don’t require 60 votes in the Senate, I said this in another thread, all the DOGE examples of fraud should be in very short to the point laws that could get passed by the House and Senate or we find out who the RINOS are with enough time to primary each and every one of them.

I’m talking about National Security, like dealing with terrorist organizations like the Houthis and Tren De Aragua and MS-13, and even domestic terrorists.

In other words, counter-attack with similar tactics. “OK, we comply but these things take time don’t you know.” It is going to be a very long four years. So very unnecessary.

Even though they can never get a conviction, impeaching a judge would effectively strip him of any ability to hear any case involving the government during the impeachment process. Set up a committee and delay the trial until after Trump is out of office.

Sometimes the process is the punishment.

I think we need a statute that removes a judge automatically after a fixed number of appellate overturns. They can be reinstated by Congress after they give a look at the cases.

Budgetary reconciliation matters and certainly cutting the budget is could possibly qualify, much like the Democrats did when they passed Obamacare.

AGREED!

When an EO, or part of an EO, is challenged, I would issue a NEW EO with more detail/directives and revoke the one that is being appealed. I would have hundreds ready to go.

BTW, Trump should issue an EO a day for the rest of his Presidency. NO subject is too small. FLOOD the zone!!! This will bind up the next DEMOCRAT administration for months.

Absolutely. This is exactly what the Communist/Democratics have done for years.

Even if a rewrite of a statute or order is blatantly unconstitutional, States like California blatantly challenge
the citizen-Plaintiffs to run it past the legal barriers. It can take decades for resolution, even with appeal to the Supreme Court.

Even without the benefit of having leftist Judges throwing down roadblocks, a savvy attorney can employ numerous
countermeasures to prolong the legal battle.
