The U.S. Court of Appeals for the Tenth Circuit overturned a lower court ruling that had dismissed a lawsuit challenging Oklahoma Governor Kevin Stitt’s anti-trans birth certificate policy, which categorically prohibits transgender people from correcting the gender marker on their birth certificates to match their gender identity.

All three members of the panel agreed that the lawsuit stated a valid claim of unconstitutional discrimination against transgender people and that the government’s justifications for this discrimination were irrational.

Excuse the source, but couldn't find this story elsewhere.

We're losing on this, folks, when we can't even find a court which comports with reality.

There is no such thing as a ‘trans person’.

If they cannot identify their own sex properly, then they have a mental problem, not the rest of the world..............

Way too many judges need a strong course in human biology.

Your birth is your birth and your gender at birth is your birth-biological gender, no matter what mental issues you develop later in life.

What happens when you legally change your sex because you are a transsexual?

Even if you change the sex on your birth certificate what about your so-called dead name that transsexuals talk about?

So for example , if you were born male and your name is Andrew on your birth certificate, but now you’ve decided you want to be female and go by the name Amber, can you also change the name on your birth certificate?

It seems to me you’d still would have a mismatch.

Married women in particular always have a mismatch between their married name and their maiden name. So if they’re having to verify identity they would need to produce both the birth certificate and their marriage certificate showing their name was changed.

Wouldn’t the transsexual people also have to produce documents indicating that he was changing his name from Andrew to Amber?

And if a transsexual needs to have a court order or other legal document indicating his name was changed, then why is there this great desire to change the sex on your birth certificate , when the birth certificate is still not going to be an adequate identity document for who they say they are now?

The SC will decide

THIS Supreme Court, which redefined marriage out of existence and found that the Civil Rights Act covered "transgender" and queer discrimination?

Don't be so sure.

You don’t change the original. You issue an amendment of a sort...The whole thing is stupid and the courts are wrong.

Didn’t say which way they would decide but they are in fact the final say no matter what they do

This is perfect cover for a fugitive from justice. Just move to a state which allows this nonsense and “identify” on your new driver license as the opposite sex from the one you are listed on an arrest warrant. You can hide behind that sex indefinitely.

Birth certificates do not record “gender”, they register the child’s sex.

Might as well be able to change your birth year as well to “identify” as a person 20 years younger.

Why not?

True. But they lecture us that "transgender women" ARE women.

An original birth certificate or a true certified copy is considered a legal form of id.

Altering signed documents is considered to be fraud.

The person identified on the birth certificate is not the person who signed it. Its usually a county clerk.

“…a valid claim of unconstitutional discrimination against transgender people and that the government’s justifications for this discrimination were irrational.“

“Irrational”!? That the word can be used in this sentence in this context is as irrational to the limits of possibility.

I am supposed and expected to give such a Court the respect and authority that has been traditional in matters involving my self, my life or freedom.

The courts are losing their mind and seem to expect everyone to go along with them…

The birth certificate should indicate the gender AND chromosomal makeup (e.g. XX or XY) at birth.
