Last month Judge Aileen Cannon issued a jury instruction order in Jack Smith’s classified documents case and the leftist legal analysts went apocalyptic.

FBI sent a subpoena to Trump in May 2022 seeking more records with “classified markings.”
They choose every word carefully. They did not ask for classified documents. They asked for documents with “classified markings”.
Then he was not charged under the laws for mishandling classified documents, he was charged under the Espionage Act for having “National Defense Information”. That does not require the information to be classified. This is a total set up.

Disagree. This is the one court in which Trump should get a fair shake. And reading about what Smith submitted today (and its inconsistency with the criminal charges filed) makes me think that Jack Smith himself realizes that the case is headed either for an outright dismissal, or for a trial under instructions that will mean the jury will have little choice but to acquit.
Is it true the National Archives refused to pick up boxes of Trumps documents sitting on the White House curb? Were the one under subpoena among those boxes of documents?
Did Jack Smith file a written answer to the court, or just shoot off his rat face? Internet searches keep turning up nothing but leftist spin. If anyone has a link to the actual filing, I’d appreciate it if you would post it.
I thought that Judge Cannon should have invited Ratso to submit the jury instructions as he would want them. This would force him to show his hand, after which non-leftists could point out the flaws in his theory.
Executive orders are directives to the employees of the executive branch on how to execute their duties. They are not directives to future presidents and they are not laws and don’t apply to citizens (although when the Pres directs a bureaucrat to set up a firing squad and he does it, that is scant comfort to the victims).
If his case is that Obama can order Trump around from his villa in Hawaii, through an old EO he issued to his staff well, that’s a bold plan.
Sorta like the Election 2020, where no Judge who wanted he and his family to live, or have a bundle of $$$$ placed in an off-shore account, would even hear ANY Trump Appeals and/or Cases, for frivolous reasons.
Rest assured, the Fix is in for this Case, as in NY Illegal Prosecutions, and for any other "Get Trump" cases.

Thanks! I have not been aware that Smith’s prosecution uses an Obama Executive Order to charge O’s successor. What total bs. Cannon’s jury instruction concepts indicate she thinks that is worthless.
