The state of Arizona has dropped all charges against former Arizona State University student Tim Tizon, the Liberty Justice Center recently confirmed to The College Fix.
As an Arizona State University student and member of Young Americans for Liberty, Tizon was arrested and charged with criminal trespass in the third degree for distributing copies of the U.S. Constitution outside the ASU Memorial Union early last year.
“We’re glad the state has dropped the charges, but this never should have happened,” President Jacob Huebert of the Liberty Justice Center told The Fix via email.
“We are glad that these charges were dismissed against him, but we need Arizona State to change its policies to make it clear that you can exercise your free speech rights without worrying about getting arrested or having a [criminal] record,” he said.
Tizon, a student at the time of the incident, was arrested by the ASU Police Department on March 3, 2022.

Now imagine if he had handed out copies of the communist manifesto or burn loot murder propaganda. He’d be let off scot free.
If he instead handed out Rules for Radicals or the Commie Manifesto we’d have never heard about it.

Headlines you would have never thought to be necessary in our nation. The charges against the student should not have been even filed.
Rules for Radicals are a great set of principles for anyone trying to dislodget the status quo - like the present deep state. There is nothing "radical" or "communist" about the principles espoused.
Well...it is a pretty subversive document...

They don’t just drop charges.
Ok so he had that right. Did the cops have a right to harass? Think about it. Cops and judges know their efforts get no where but the ‘interruption’ will get him to think twice. So they run with some flimsy excuse. Cops just ‘doing their job’. ASU is a ‘government’ campus. Harass first ask questions later. The damage is done. How many students would follow up and do the same because it’s the right thing to do?
“Leave me alone-where’s my gumbo?”
In other words his rights were already violated, dropped charges or not.
Hasn’t the Constitution been designated as hate speech? It’s just a matter of time.
Actually there is a civil lawsuit to follow. The police who arrested him denied him of his First Amendment right. They lose their qualified immunity. This is not over. The criminal trespassing charge fell apart probably because you can’t be charged with trespassing unless first told about the trespassing. Probably wasn’t. Need more info. Civil lawsuit to follow.

That is an important point. Do cops ever say: “This person doing nothing wrong. Nothing. So I will not follow orders. I will not arrest him.”
I guess not. Once you have qualified immunity, just go with the flow.

CRIMINAL TRESPASS UNDER ARS 13-1502
Per ARS 13-1502, third-degree criminal trespassing happens when someone has been requested to leave a property by its owner or another individual with lawful control and has refused to comply. The person must have been reasonably requested to leave by someone with authority, like a police officer.
Third-degree trespassing can happen when someone violates a “No Trespassing” sign. It can also occur when someone remains on train tracks or railroad company property unlawfully. This is a class 3 misdemeanor that can result in a fine of $500 or less (plus a surcharge) and up to 30 days in jail.
It happens a fair amount. Probably more in the past. Now every second a policeman is on duty, he is tracked, and possibly recorded.
I have talked to officers who have done it, sometimes as a matter of principle.
It almost never makes the headlines.
ASU has a free speech zone. He was handing out constitution booklets outside of that. You see, he mistakenly thought the free speech zone ranged from coast to coast.
I would like the name of the prick cop who thought he could arrast for speech outside of the free speech zone. And also the prosecutor who did not immediately dismiss the case.
The FBI is on the enemy side so nobody will prosecute the cop for civil rights violations. But he needs to pursue a civil case against him for the illegal arrest.
