Townhall’s Kurt Schlichter lays out how New York’s lawsuit against Donald Trump will go

As Twitchy reported, Washington Post columnist Jennifer Rubin went on a Twitter bender earlier Wednesday when news broke that New York State Attorney General Letitia James was filing a lawsuit against Donald Trump for “engaging in years of financial fraud.” Of note: It’s not a criminal lawsuit, but a civil lawsuit. As long as James has been investigating Trump, she doesn’t have the goods on him to file a criminal lawsuit.

Lawyer and Townhall columnist Kurt Schlichter has laid out in a short thread just how the lawsuit is going to go. In short, Rubin might want to calm down.

I have only skimmed this dog's breakfast of a complaint, but what popped out at me for the parts I looked are were the lack of damages allegations, much less ones against NY, the plaintiff. You cannot sue if you did not suffer a loss. None are pleaded in the parts I looked at.

A comment I saw about the press conference announcing this, was that there were a lot of people standing around behind her, whose body language said they really didn’t want to be there.

And I hope red AGs are taking note of the new rules.

If any red-state AG committed this sort of prosecutorial abuse he or she would go to prison. Still, as Schlichter points out, these are the new rules. So are the ones that gave us the grotesque J6 "Select Committee".

The specifics of the case probably sounded so much better inside her own head. Now that the charges are out in the open, they may be examined and the true motives revealed.

Envy and prejudice make for poor law.

When I heard Letitia had scheduled a morning announcement, I had expect worse, much worse for Trump.
I’m glad it wasn’t as I had expected, at least not yet.

To put a twist on one of Rush’s favorite song lines:
“If she can’t convict Trump by now,
She will never, never, convict him.
Woo. ooo. ooo!”

The pictures I have seen are pretty much standard for the crazies.

The people standing behind her looked like ghouls. The expressions on their faces would go well with torture, a burning of Joan of Arc at the stake, etc.

Actually, it’s trap. The FBI stole Trump financial and tax docs. They are trying to get the Trumps to respond so they can get them on a process crime perjury charge

There must be a claim for damages in order to file a civil case for Fraud.

If I claim my outhouse is worth a million dollars and a bank loans me the money on the basis of my assertion that it is worth a million dollars, there are no damages unless I don’t pay the loan off.

And if I don’t pay it back, the bank has to prove that they only issued the loan based on my material misrepresentation. If they didn’t actually rely on my claim and did their own due diligence to get an independent appraiser to appraise the property then they might have a suit against their appraiser.

If a bank fails to do their own due diligence in verifying the value of the property, they would be estopped from claiming they were defrauded.

It’s damned hard to prove fraud.

There the rub

They have his records. So does he. Sure they can fabricate something out of whole cloth, which wouldn’t surprise me, but then they would be banged for lack of Disclosure and the President has the ability they’re producing false evidence.

This is the last resort for her. Lots of time and money spent on her investigation. One in which, she played no active role in conducting. She wasn’t sitting there going through his tax records or appraisals. Some underling was doing that. I’m betting that, finally, someone told her that this whole thing has been a gigantón waste of taxpayer time and money. They have nothing.

So she’s slinging as much poo against her wall as she can.

It WAS a tremendous waste of taxpayer money and the time of the AG's office. James is a disgrace, but as a black female AG she's untouchable. Except by the voters.

On other thing, if a bank loans you a million dollars using your outhouse as collateral, that is prima facie evidence that the value of the property at the time the bank loaned the money was at least a million dollars.
