Durham Releases ‘Smoking Gun’ in Case Against Hillary Lawyer

On Monday night, special counsel John Durham released what could be the smoking gun in the case against Hillary Clinton lawyer Michael Sussmann in his investigation of Russiagate. According to newly published documents, Sussman, who was indicted last September for concealing his clients, messaged the FBI general counsel on Sept. 18, 2016, and said unambiguously that he was not working for any client while he was, in fact, working for Hillary Clinton’s presidential campaign.

Sussmann’s lawyers claimed last year that the charges against their client were false and that they were made based on an unsubstantiated verbal statement.

“The Special Counsel has brought a false statement charge on the basis of a purported oral statement made over five years ago for which there is only a single witness, Mr. Baker; for which there is no recording; and for which there are no contemporaneous notes by anyone who was actually in the meeting,” Sussmann’s lawyers alleged at the time.

You must be joking. What Durham did was the equivalent of looking through a several square mile landfill for something he did not even know existed and evidence re actions no one *knew* anything about that would stand up in a court of law. For an indictment, let alone a conviction, it’s not enough to have vague suspicions. You need hard proof. And the perps aren’t morons who leave tracks. These are some of the smartest people on the planet, with Ivy League degrees up the wazoo (it’s not that the Ivies made them smart - the Ivies are a filtering mechanism - you don’t get there without major league smarts). That Durham managed to get *anything* on Sussman is a minor miracle.

Yep have heard Durham is going to do this and that for years. Nothing is going to happen here to the big fish and probably nothing to the little minions. The dual track justice system is firmly entrenched in the US Kangaroo Court system at this point.

Not only was it an oral reassurance to Baker, but a written message to Baker
from the Clinton hack lawyer as well. He lied at least twice to the FBI.
Will anybody care? We will have to wait and see.

“Indeed, on September 18, 2016 at 7:24 p.m., i.e., the night before the defendant met with the General Counsel, the defendant conveyed the same lie in writing and sent the following text message to the General Counsel’s personal cellphone,” Durham wrote in the filing.

The text message, according to Durham, stated: “Jim—it’s Michael Sussmann. I have something time-sensitive (and sensitive) I need to discuss. Do you have availability for a short meeting tomorrow? I’m coming on my own—not on behalf of a client or company—want to help the Bureau. Thanks.”

Baker replied: “Ok. I will find a time. What might work for you?”

Sussmann responded: “Any time but lunchtime—you name it.”
