I work in an engineering department at a tech company in the USA. I've worked on many hiring projects over the years but the latest project is different to the others. In the spreadsheet that lists all the open positions, there's a new column next to open positions with DEI comments. It has a line like this:
Senior Software Engineer (must be female)
If I follow this spreadsheet and exclude male applicants, then would I break any laws? Or if not laws, then would I violate other regulations or ethical standards in the industry?
I ask because my understanding of anti-discrimination law is that there are certain classes of people that cannot be excluded from job openings. Things like sex and race.
If this is illegal then what's the right way to handle this? Are there other ways I should think about this besides legal/illegal or ethical/unethical? Does region or state within the USA matter?
A little more context:
As a SSE I would do interviews or screen candidates but now in a Sr Manager role I'm more involved in the early planning and management of the process. In the first meeting where I saw the comments I said nothing. I followed up a few days later with an email to VP eng to say I opposed. 2 days after that I had a call with VP eng where I raised the issue again and they insisted that the requirement remain. I've taken no more action after that.
Yes - you are.
Yes. That is clear discrimination.
The fact that you are not allowed to question the merits of DEI (Diversity, Equity, Inclusion) tells you all you need to know.
Obiously illegal. Ask HR to get it documented.
If it said “whites only”, what would you think? That would be my answer.
No one will do anything about it.
“Affirmative Action” is clearly un-Constitutional under the 14th Amendment and Alfred Blumrosen knew it when he wrote the first regulations in his newly created EEOC.
How about we start promoting equal representation in the blue-collar trades: carpentry, electrical, plumbing, mechanics.
In contrast, we also demand equal representation in fields like nursing, teaching, child care.
you could anonymously report it to I don’t know the dept of labor? But instead why not send it to somebody like Fox news?
Might want to look at whistleblower laws and then consider contacting the state.
My experience with HR tells me that you will just get in trouble if you ask them about something like this. They are not there for you. They are there to impose Diversity on you.
The only defense we reasonably have is to choose who we do business with. I talk to people all the time that pretty much fully agree with me politically and morally. They agree what these woke corporations are doing is wrong and destroying this country. Yet they continue to business with them. I work very hard not to do business with places like target, Amazon, McDonnalds, AT&T, Netlix, NFL, NBA and on and on. But these people I talk to have not changed their behavior at all with these businesses. The reason is that it is convenient to do business with them. That is why we are, and will, loose. Hardly anyone is willing to make even the smallest sacrifice to stand up for America and American values. it’s pretty depressing really.
You might as well break some other laws too. :-)
Ask as many people involved what the reasoning is behind it. Send requests in writing, save copies of those. Log in days requests were made and when responses were made, and obviously keep those. At least they’ll wonder that if something is amiss, they might get their asses caught in legal entanglements.
Title IX only protects women according to our legal dept.
You aim far too low.
I demand equitable hiring of white men in NBA basketball.
If you want to get HR is deep shit, send that to a labor attorney.
It has been my experience that HR works for and is a tool for Management. HR is not your friend. Agree, whistleblower law and go to state.
Do you work for Wind River Systems? Look at their pie charts (scroll down).

They’re opening declaring that their goal is to reduce the percentage of white men - specifically. How do you do that unless you’re not hiring and also firing WHITE MEN?
I find it astonishing they’re so brazen about it. If you replaced “white men” with any other demographic you’d be sued endlessly.
Is it a publicly traded company?
