Could a "Point of Order" in the US Senate defeat the "BBB" ("Build Back Better") legislation?
According to the US Constitution, on a split 50-50 vote, the Vice President controls a tie-breaker vote in the Senate.
Could a single Senator defeat that vote, by raising a "Point of Order" questioning the eligibility of the VP to hold her office?
Foreign nationals present in the US on "Student Visas" were not considered "residents" in 1964, and a US born child did not meet the requirements for US citizenship according to laws in effect in 1964. Fraud committed by her parents, allowed Kamala D. Harris to remain in the US (and probably prevented their deportation at that time as well).

It would only take one Senator to raise an objection, and then evidence could be introduced (in advance of a vote on its merits).

This question breaks down into a couple of discussion points.
1) Can a senator raise a point of order, yes.
2) However, according to the rules of the Senate:
A question of order may be raised at any stage of the proceedings, except when the Senate is voting or ascertaining the presence of a quorum, and, unless submitted to the Senate, shall be decided by the Presiding Officer without debate, subject to an appeal to the Senate. When an appeal is taken, any subsequent question of order which may arise before the decision of such appeal shall be decided by the Presiding Officer without debate; and every appeal therefrom shall be decided at once, and without debate; and any appeal may be laid on the table without prejudice to the pending proposition, and thereupon shall be held as affirming the decision of the Presiding Officer.
So... the presiding officer is LIKELY to be KH herself. Even if you pushed it to an appeal, the ultimate answer would come back to 50/50.
Now if a Democrate senator was unable to be present or attend due to illnes. Then you could possibly get a differet result but that would be unlikely as the main vote would no longer be 50/50.
And you are now WAY down into the weeds of the rules.

Republicans wanted the natural born citizen clause neutered as much as the Democrats.
Cruz, Jindal, Haley, Rubio and George P. Bush are all ineligible and they were the future of the party, so the GOP went along with the Kenyanesian Usurpation.

One can only hope that for once the GOP would grow a spine, and for once united, stand firm and refuse to confirm a VP. Much of the insanity would end if the Dems did not control the senate.
