He was shot at but I don’t think he was shot at by the two guys he killed. I still think it was straightforward self defense, however.
To all Democrats, Kyle is guilty of not letting himself be counted as another covid death.
From what I have seen, the prosecutors arrived in a clown car. They argued with the judge, saying the judge doesn’t understand the law with regard to hearsay evidence. They also objected saying that a police detective is not an expert in firearm safety.

This was open and shut self-defense and he was railroaded by the Feds and DA's office as an election stunt.
Standard practice is that the defense does so at the close of the state’s case. If they do so before that State will claim they still have more evdidence to provide and motion will be denied.
The FBI almost certainly knows the ID of this shooter, but has never revealed it, and Kenosha police describe him as ‘unknown’

The shooter was the tall thin bearded guy with Kyle at the gas station. He was holding pistol by his side and with his heavy set armed girlfriend.
In one video, he can be seen moving along the road and sidewalk toward the bottom of the lot where the shot originated. He was likely aiming for Kyle and got Rosy instead.
What his name is, is another question.
I was gonna say the headline is false. But Kyle certainly could have thought the gunshot(s) were fired at him. I have zero doubt that he feared for his life at that point. Almost immediately after that shot, he turned around, Rosenbaum grabbed the gun and Kyle defended himself. I think any reasonable person would have had cause to fear for their life.
Sounds like he's owed damages for malicious prosecution.

He should but more than likely they’ll dismiss most all charges due to self defense and convict him of the sole remaining charge of a minor being in possession of a firearm. A misdemeanor if he’s convicted with time served. However that conviction would likely prevent or make it extremely difficult for him from being able to sue and collect for wrongful prosecution!
They weren’t “victims”!
Those shot in this incident should not be referred to as “victims”.
Such a motion can be next filed at the conclusion of the State’s case.
“I’m wondering if, at some point, the defense will call for a dismissal of charges.”
When the Defense has enough information to state that not only did the prosecution NOT make a case, but also violated Kyle’s civil rights and created a scenario where unlawful prosecution was used for political purposes.
Then they will ask for dismissal.

Not a lawyer, but after the prosecution finishes presenting their case, a motion for a dismissal or a directed verdict would seem the appropriate thing.

As soon as the prosecution rests, Kyle's attorneys will ask the judge to dismiss the case.
