The Worst Part? The Democrats Can't Use the 25th Amendment

There is some speculation floating around social media (mostly, but not totally, from the right) that Democrats may try to pull the 25th Amendment card on Biden to push him aside and bring Kamala Harris forward in an effort to save face in this moment of geopolitical crisis. It is some of the same speculation you saw several times when the Left called for members of the Trump administration to turn on Trump and invoke the amendment.

However, the Democrats have put themselves into such a terrible position that they absolutely cannot get rid of Biden through this means, or else they give up the only chance they have to get anything through the Senate, and they would definitely hurt their electoral chances in 2022 and 2024.

In August of 1974, Gerald Ford became the President of the United States after Richard Nixon resigned. In order to get a Vice President, Congress had to approve Nelson Rockefeller.

“Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress,” Section 2 of the amendment explains.

This last happened in 1974, when Vice President Gerald Ford — himself a replacement for Vice President Spiro T. Agnew, who resigned after being accused of tax evasion — replaced President Richard Nixon. Ford nominated Nelson Rockefeller to serve as his vice president, according to the Gerald R. Ford Presidential Library and Museum.

At least 35 House Republicans and at least 10 Senate Republicans would vote for whoever Harris nominates.

The article indicates that the GOP could block a new Vice-President from being approved, because in a 50-50 Senate, the Republicans would not approve anyone.

What about the Mitt Romney, Lisa Murkowski, Susan Collins types? I find it hard to believe that they would vote against a perceived quality candidate for Vice-President. If even a single Republican breaks ranks, then you have a 51-49 or greater approval vote for a new Vice-President.

Section 4 is the applicable section:

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

The way I’m reading it (and no, I’m not a constitutional scholar) is that the VP would become the ACTING President and assume the powers and duties of the office, not that they would remove the sitting President.

Since it’s never been done, I could absolutely be wrong!

The dims have a second problem in that Harris is highly disliked. I’m not so sure the public would like to see her in the oval office.

You could count on some Republican senators to approve Harris's VP choice. In part because they figure she has a chance to have a VP of her own choosing, but mostly because they don't want Nancy Pelosi to be one step away from the presidency.

If Harris does try to push Biden out, though, it could split both parties, because some Democrats still like Biden and some Republicans like Harris even less than Biden.

Which, if they were smart, they’d refuse to let the Harris nominee become the tie breaker. They could even argue to wait until 2022 to see what the ‘will of the people’ was. We’ve lived without a VP for a lot longer than that. But it would only take one defection to give the dems control of the Senate.

In addition to the republicans, maybe Pelosi wouldn’t want to have anyone be vice-president. She would then be next in line if Harris is removed or something happens to her.

No way the Dems want Harris. She has less of a chance of helping the Dems than Biden. It is a disaster all the way around.
If the Dems could wave a magic wand and have a new President, who would it be? Not Harris, not Bernie Sanders, not Hillary. Who?
