A Travis County grand jury has indicted an active-duty former Fort Hood Army sergeant on charges of murder, deadly conduct and aggravated assault in the 2020 shooting death of an armed Austin protester.
Perry, who was stationed at Fort Hood, was working for a ride-sharing company and just dropped off a customer when he turned onto a street filled with people protesting police brutality.
He stopped his car, honked, and seconds later, police said Perry drove his car into the crowd, The Texas Tribune reported.
But videos show that he was under attack contradictory to the police reports!
The man who defended himself against BLM rioters was indicted today a year after the incident is yet another example of how illegitimate our justice system is.
Army Sgt Daniel Perry was driving Uber when rioters mobbed his car and pointed a gun towards him
Below is the video that is widely shared by the mainstream media:
When the crowd surrounded the car Perry encountered Foster, a 28-year-old Air Force veteran, who was holding an AK-47 rifle. The rifle was legal under Texas open carry laws.
The media describes mobbing his car and pointing a gun towards him as “motioned with the assault rifle for Mr. Perry to lower his window”.
Shortly before being killed Garrett made it clear why he was there as you can see in the video below:
Also, the media or the police in their court documents never mentioned that another BLM rioter shot at Perry shortly after he defended himself. Perry then fled and immediately called the police upon getting to safety.

Side-by-side video with both angles, you can see Perry come to a complete stop before having to defend himself from the mob and Garrett Foster
Perry’s attorney, Clint Broden, said Perry had dropped off a passenger near Congress Ave. in downtown Austin and was waiting for more clients when he encountered the group of protesters.
According to the press release from Broden, “when Sgt. Perry turned on Congress Avenue, several people started beating on his vehicle. An individual carrying an assault rifle, now known to be Garrett Foster, quickly approached the car and then motioned with the assault rifle for Mr. Perry to lower his window.”
Broden said Perry believed Foster was with law enforcement and complied. Perry then fired the handgun after Foster raised his assault rifle toward him.
After Perry fired his handgun, a member of the crowd began firing on Perry’s vehicle, according to Broden.
Broden said Perry never left his vehicle following the shooting but immediately called police upon getting to safety.
Perry turned himself into the Travis County Jail on Thursday.
I’ve seen this movie before. The DA will plea bargain it down to nothing. It’s the conviction he needs for the publicity but he won’t dare put it before a jury.
No. It is not his responsibility to search out ways thru city to avoid an illegal assembly. He has a citizen’s right to traverse that road unimpeded. He also has a human and Tx state right to be armed at any time he darned well wants. He complied with orders from a presumed copper, who then threatened him with deadly force.
Good on him for shooting in self defense.
Abbott should have replaced Austin police force with Rangers or National Guard months ago, as local coppers have no interest in enforcing law except along political lines.
Just like the kid in Kenosha...it’s a pattern.
Nonsense. He was driving a shift as an Uber driver. And was licensed to carry. How do you know he could have easily "bypassed it"? Were you there?
...........whoa.......not necessarily, I won 3 jury trials in Austin’s “Environmental Court” over an environmental issue which Austin people are KNOWN to be rabid about. Plus I’m a straight, white guy, developer. So, you would think I would be dead meat and I think that’s what the prosecutors thought. But, 3 times Austin juries turned them down FLAT and ruled for, HORROR, a developer!
Austin juries have had a long history of being open minded and some trial attorney’s prefer trying cases in Travis County when they can.
Prove he knew a protest was going on, citizen have a right to free movement around a city
In my county this wouldn’t have even brought to a grand jury. Change of venue and this goes away. Austin is a 3rd world Texas crap hole.
They are not Texans
Even here in Nashville the ANTIFA coordinator was from Portland
Recruiting woke east Nashville bohemians and flying in her own cadre as shock troops indistinguishable from BLM
They offered my daughter 1800/month to be on call to go anywhere USA to protest
They had ads up online and in bars and places young millennial lefties frequent....east Nashville and sylvan park and Vandy area are Nashville white leftist enclaves
Agreed, the moment a firearm was pointed at him he had reason to draw his gun. Moreover, an AK with 7.62x39 could go right through the window, simply being in the car didn’t make him safe.
Don’t believe anyone can inpute premeditatatuon by being there. He was nearby to drop off a passenger, he didn’t head to downtown Austin for trouble.
Bkmk
Eravis county is a tumor, a deadly growth of the cancerous leftism the demon rat party utilizes for their killing of the we the people dying Republic. BLM terrorism is seeking to start the race war the demon rats lust for.
He might not have known about that particular area and he was blocked from behind and couldn’t just turn around...he was also driving for UBER...you know picking up passengers and stuff which might have sent him into that area looking for pick-ups.
Perhaps you should ask your other brother “Zathras” to make a more rational posting!
Our country, this world, is finished. Justice is DEAD, injustice is growing by leaps and bounds.
It ended the night George Zimmerman defended himself from the punk Trayvon Martin.
There is video of the scene that night showing Trayvon’s body covered by a bright yellow plastic blanket with a can of Arizona, Watermelon, “FRUIT JUICE COCKTAIL” forever to be know as iced tea.
Uncuffed George Zimmerman standing in the rain talking to police, police having been told by an “eye and ear” witness who lived in the closest (VERY close) apartment that Trayvon Martin was pounding George Zimmerman’s head into the concrete sidewalk, the witness had even talked to Trayvon Martin and told him stop.
Those police on the scene made the right decision NOT TO ARREST George Zimmerman and let him go home.
THEN, all hell broke loose. The FAKE media, the woke, perverted, racist (against whites (other than Black)) people became unhinged and only by the grace of God was George Zimmerman acquitted.
Did Derek Chauvin stand a chance in the “post Trayvon” era? HELL NO!
Derek Chauvin DID NOT KILL George Floyd, PERIOD! HE DID NOT KILL HIM!
George Floyd (a worthless POS drug addict felon) KILLED HIMSELF!
Shed no tears for George Floyd. The world is a better place WITHOUT him. The world is a better place WITHOUT Trayvon Martin. The world is a better place WITHOUT Michael Brown.
I will never be shot by police. Not because I am “white”, but because I will not RESIST, I WILL OBEY law enforcement. I WILL NOT RUN from law enforcement. I will not brandish a weapon at law enforcement. I will not be under the influence of any substance when in contact with law enforcement. I will not be committing any crimes when in contact with law enforcement. I will not be violent when in contact with law enforcement.
“Yes sir, no sir.”
“Yes, officer, no officer.”
It is real easy NOT TO GET SHOT by police.
If he draws a lib judge, look for the Multiple Videos to be excluded from the evidence.
hmmmm...and Ashli Babbitt’s murderer is ...???
Inquiring minds would like to know
If he had turned around, drove the other way and then someone pulled a gun, then he would be 100% in the right.
Can you prove (or can it be proven) that he knew what lurked around the next corner? And that he deliberately entered the danger zone planning "to git me one of 'em"? If you (they) can't prove it, then it's a no-bill from the Grand Jury or a not guilty at the trial.
You should consider actually reading the story before you pipe up and make yourself look like an idiot.
