Yes, Justice Roberts, There are “Obama Judges” and “Bush Judges”
DB Daily Update ^ | David Blackmon

Posted on 07/25/2020 6:26:04 AM PDT by EyesOfTX

A tale of two judges. – Chief Justice John Roberts – the clearly-compromised former conservative jurist who now does the bidding of the progressive left whenever they demand it, apparently – famously stated in 2017 that there are no “Obama judges” or “Bush judges,” there are only federal judges. That, of course, is abject bullshit, but hey, it’s what the Chief does these days.

Late this week, we saw the dichotomy between the kinds of decisions we get out of Bush/Reagan/Trump judges and Obama/Clinton judges in two decisions related the ongoing rioting taking place in Portland. It is a classic tale of an Obama judge applying his own personal baises as a means of fomenting more chaos in our society and a Bush judge doing his best to properly interpret the law and put out the fires.

The first decision came from the Bush appointed, District Court Judge Michael Mosman, who rejected the specious filing of Soros-funded Oregon Attorney General Emily Rosenblum. The despicable Ms. Rosenblum was asking for a temporary restraining order that would deny the right of federal law enforcement officials to continue to protect the Portland’s federal courthouse and other federal property from the rioters, who have attempted to burn the courthouse down many times in recent weeks.

Michael W. Mosman - Wikipedia

Judge Michael Mosman

From a report at Red State:

The complaint — filed by her on behalf of all Oregon citizens based on her in parens patriae status in relationship to those citizens — alleged violations of the citizens First, Fourth and Fifth Amendment rights under the Constitution. The factual allegations were that unknown federal agents, without names or insignias our their uniforms, and driving unmarked vehicles, were detaining and arresting Oregon citizens off the streets of Portland away from the federal courthouse, without probable cause.

In denying the TRO, Judge Mosman questioned whether the Attorney General had standing to bring the action she had brought. The parens patriae status she claimed — meaning the government as legal protector of citizens — is rarely invoked, and likely inapplicable where, as here, citizens wrongly arrested or detained by federal agents could sue on their own behalf for violation of their civil rights. Judge Mosman noted that the Attorney General could bring suit to vindicate a legal interest that is specific to the state itself, but the complaint filed by the Attorney General states no such claim.

The Court noted that no protester was a Plaintiff. The Court noted that the lawsuit sought no remedy or damages on behalf of anyone claiming to have been harmed by the actions of the federal agents. Instead the lawsuit the extraordinary remedy of prohibiting future law enforcement action by agents of the federal government.

The Opinion calls out the Oregon Attorney General for writing a complaint in a fashion that suggests numerous protesters have being seized off the streets of Portland, but in support of which at the time of the hearing the Attorney General was able to produce evidence of only two events. There was evidence of a young man named Pettibone having been arrested and taken to the federal building, but he was never charged. The evidence, however, was limited to a declaration by Pettibone as to what happened. There was no evidence to corroborate his claims.

The Opinion next notes that the video of another arrest by federal agents offered by the Attorney General had no information as to context of the arrest — what had happened, if anything, prior to the person in the video being taken into custody. The Judge noted that it could be the case that the law enforcement agents in the video were acting on probable cause — there was no evidence to lead to one conclusion or another on that issue. Without any evidence of the context for the actions of the agents, the video was meaningless. [End] That was the Bush Judge decision.

The decision from the Obama Judge – District Judge Michael Simon, who is the nephew of famous playwrite Neil Simon and looks just like him – came late on Thursday. In his decision, Judge Simon issued a TRO prohibiting federal law enforcement from using tear gas or any other non-lethal force that might impact members of the press or “legal observers,” many of whom are radical leftists who have embeded themselves in with the rioters.

Michael H. Simon - Wikipedia

Judge Michael Simon

Well, you can see where this is going, right?

From a report at Politico:

A judge has barred federal law enforcement officers dealing with long-running protests and unrest in Portland from using force against journalists and legal observers trying to document the run-ins between activists and the authorities.

Ina temporary restraining order issued on Thursday night, U.S. District Court Judge Michael Simon also declared reporters, photographers and legal observers exempt from any directives issued to the general public to disperse from areas where protests are taking place.

Simon said there were strong indications [Note the expression of his own opinion absent any real evidence that this is true] that journalists were being targeted by the authorities and were not simply incidentally caught up in legitimate efforts to quell violence or vandalism.

“Plaintiffs’ declarations describe situations including that they were identifiable as press, were not engaging in unlawful activity or protesting, were not standing near protesters, and yet were subject to violence by federal agents,” Simon wrote. “Contrary to the Federal Defendants’ arguments, this evidence does not support that the force used on Plaintiffs were ‘unintended consequences’ of crowd control.”

[End]

So, guess what happened Friday evening? Check it out:

Boy, there’s a shocker, huh?

Thus does Judge Michael Simon – an Obama appointee – very predictably reveal himself to be an active participant in the radical left “resistance.”

But hey, there’s no difference between “Obama judges” and “Bush judges.” Just ask John Roberts.

*sigh*

That is all.

Believe me, I have nothing good to say about Souter, so that can be dropped. But are there ANY Democrat-Souters, Democrat-appointed justices that will ever vote with us on tough issues, or even admit that the Constitution is the ultimate authority? Certainly not among those appointed by Clinton and Obama, and no way in the future. I’ve already named 2 Republican-appointed justices who totally respect(ed) the Constitution and most others come very close...slipping up once in while, though. Roberts, I agree, gets closer to the middle, getting it right, sometimes (such as the recent death penalty cases). But where are the Democrat-justices? We all know that answer.

So the idea is to ACCEPT the fact that some Republican judges are screw-ups, because they’re human, but if you look at the history of the screw-up justices it is very rare that they all screw up at the same time - so get a 6-3 Republican majority on the court and the screw-ups will drop by 80% (since we can now lose one), get a 7-2, and the screw-ups will drop by another 80%. Get an 8-1 or 9-0 majority, and then BIG THINGS could happen (maybe), like declaring Social Security and Medicare unconstitutional, since they are not in the Constitution.

...but how will any of that happen if Republicans sit back and let Democrats appoint all the judges?

Read my other post - we DO NOT get cooked if we can get the court 6-3 or 7-2. We actually WIN, instead of losing for the rest of our lives and the rest of our children’s lives (if that matters).

Very true...

Like it or not the Ds do ‘stick together’ and will close the ranks if one of ‘theirs’ gets in some unethical ‘difficulty’ while the Rs will go out and ‘buy the rope, tar and feathers’ when an R ‘strays’.

Funny how out of 400 or so Ds probably couldn’t get 5 of them to order the EXACT same meal off the same menu yet will vote lockstep on no matter the issue 98% of the time with the only dissidents being ‘named’ as they may be in an upcoming tight race and if the vote is ‘solid’ they may be given permission to ‘stray’ if for no other reason than to hold their seat.

Of course it gets so bad now that if an R strays from the fold they are most generally branded as traitors no matter what their conscience or beliefs may be.

Politics has turned into a ‘popularity’ contest where the only seemingly goal is to get reelected which the Congresscritters have to ‘hit the ground’ running and start raising money for the next campaign only 2 years away.

AND every 2 years the ‘wags’ will say...
The most important election of our lifetime, like it doesn’t happen every two years.

I think a good start would be to limit contributions to be only from those you will represent...may be a bit harsh but there is no reason for Texas and New York money deciding who the Mayor of Podunk Falls will be.

Face it in local elections one can own all the business in town yet if he doesn’t live in the town limits, he has no vote BUT is surely able to attempt to ‘buy’ all the candidates....

Roberts claim that the justices aren’t biased, they just call balls and strikes, shows how the Left, which he has become a part of, looks down on the hoi polloi. Roberts would’ve called fauci’s pitch a strike.

With Soros (and those like him), I would agree with that! Rich conservatives vastly outnumber them, but are total tightwads with their money, or, just as likely, afraid of the Brownshirts if they give to the ‘wrong’ candidates.

though. Roberts, I agree, gets closer to the middle, - and then BIG THINGS could happen (maybe), like declaring Social Security and Medicare unconstitutional, since they are not in the Constitution.

OK, we have a fundamental difference of opinion on "Republicans"

The second part of your statement will NEVER happen with Pirates like Roberts

One soon to be revelation of the "Republican" Senators will be the vote on the latest FED member - She believes in REAL MONEY - as in GOLD. Will she be voted to the FED - Will she actually do / be able to do anything about the coming inflation

I am a LIMITED G'ment kind - we have WAY too many laws, and we are debasing the Dollar.

People like Roberts, Romney, as private citizens are irrelevant, some like McCain are even courageous, However as Politicians, they become tyrants.

At least the Greeks voted these Tyrants off the Island into 10yr. exile

“The second part of your statement will NEVER happen with Pirates like Roberts”

...except they are NOT all like Roberts, which is my point.

Yea, it’s easy to nitpick and imply Democrat judges would be better for the country (unless you’re able to tell us another alternative)...but it is not even close between them (other than Souter).

Sorry.

Ok, I think we’re on the same page - which is that anyone who considers Roberts no better than Democrat judges is an idiot.

Welcome to the idiot club because Roberts can be just as bad as RGB when it comes to destroying the Constitution, Gorsuch ripped several pages out of it last week with his gender ruling.

“can be”

Sure, and there was a race-related case where Thomas sided with the liberals - so I guess he’s a sellout too and we should all vote Third Party?

You guys can do better.

Well, it's not like fanatical partisan Democrat ACLU lawyer Michael Simon is married to anyone like fanatical partisan Resistance Democrat Suzanne Bonamici, who represents Oregon's 1st CONgriftional District in the US House of Representatives...

Oh, wait...

Note the date - July 16th.

Wonder if Suzanne had any "influence" on the final decision of the "court".

“So can Roberts and Gorsuch Bib.”

So could have Reagan (who gave us Sandy, who was far worse than Gorsuch and worse even worse than Roberts) And so, I guess, Reagan was a sellout to the this country too, by your standards.

Likewise, the country would have been better off if Carter was re-elected, I guess, by your standards.

Not a sell out but certainly he made some decisions that turned out pretty bad. Fact is some of the worst Supreme Court Judges were appointed by Republicans. Those judges were the result of compromising with the enemy that would never compromise with you, when they have the upper hand.
