I received a call from my brother this evening with an interesting quandary.
Our mother passed at age 92 in April of 2018. Today he received a check for $1,200. The check clearly states:
(My Mothers Name) DECD
% (My brothers name)
(My brothers address)
It is also labeled as: "Economic impact payment"
My brother, the executor of the very modest 'estate', was asking my advice. I suggested, depositing it, while we seek further information or consultation from an attorney (my BIL).
Neither of us need the $600 bucks (after the split), nor do we feel it should have been sent to our mother in the first place, for the obvious reason.
I'm thinking we use it as a campaign contribution to the President?
The important question is:
Was her November ballot also in the envelope?

Apparently, it’s just the way the law was worded, and it’s purely based on whether the taxpayer filed a 2018 or 2019 return. No exception for the taxpayer being dead now. Presumably, your brother filed a 2018 return for your mother (and possibly a 2019 return as well for the estate). So it’s no mistake, except by Congress.
Well, she paid the taxes that funded the payment,so it only seems right her heirs should get it. But there’s an office of the treasury that accepts voluntary payments...

If the most recent tax return was filed under the person being deceased, checks are being received made out to the deceased’s estate mailed in care of the executor.
In other words, any person who filed a return for 2018 or 2019 taxes got a check...no one bothered to consider everyone who filed maybe should not have gotten a check.
Stories such as this and the fact big public companys rather than small businesses received ‘free’ monies might be the reason Mr. Fine was replaced by President Trump by a new ‘overseer’. Many mistakes have been seen by this Fine character.
This money is meant to help people, not politicians, not even Trump. If you don’t need it, your local businesses do, as do charities which must be taking a huge hit right now. How about your mom’s favorite charity?

The receiver (assuming some tax return was accomplished in the period after the death) should get the money, and everything is legal. I kinda agree on donating part of it to the Trump campaign, or that of individuals in districts trying to get the Democratic representative out.
Now, if the relative had passed away in 2012, and the check still came....that might be something to ask serious legal questions about.
Good thoughts and I am going to take that a step further, one on the same line, but more personal.
Mom's hairdresser. Did mom's hair for years. Small shop one she owned herself.
At Mom's memorial she and I spoke, she had a very sincere admiration and friendship with my mom. After mom became too frail to go to her, she came to mom.
She could use the money far more than I, or my brother, or the Trump campaign.

I understand what you are saying, but since Mom has passed, I inclined to have the money put to a use in a manner that mom would approve.
