Sidney Powell has the corrupt DOJ lawyers on their heels. Some big developments took place in the case involving the coerced guilty plea by General Michael Flynn on Wednesday, as both sides made a series of key filings with the court.
First, General Flynn filed a motion to dismiss the case entirely, citing an array of government misconduct that is backed up by overwhelming documentary evidence.
Second, General Flynn filed a declaration requesting the court allow him to remove his plea of guilty entirely, citing misleading statements and document revisions by the FBI agents who performed the January, 2017 entrapment interview Peter Strzok and Joe Pientka along with threats made against Flynns son and family by lawyers working for Gestapo Chief, er, Special Counsel Robert Mueller.
Third, the corrupt DOJ lawyers, who in December had reversed an earlier recommendation of probation for Gen. Flynn in favor of prison time, reversed course yet again, filing a revised sentencing memo, one that again recommends probation.
Obviously, Flynns attorney, the brilliant Sidney Powell, has beaten the DOJ lawyers into submission. She has clearly revealed their own multiple deceptions to the court, clearly revealed the outright mendacity of Strzok, Pientka and other FBI officials who revised the original 302 forms from the entrapment interview and then lost the original a virtual impossibility within the FBIs document retention systems and clearly revealed the despicable thuggery practiced by Mueller and his team of American Nazis.
Federal Judge Emmett Sullivan now has a decision to make: He can either sentence Gen. Flynn hopefully to the probation now recommended by the government or he can grant Flynns motion to withdraw his guilty plea and take the case to a full-blown trial. There is no question that the latter is the right way to go here.
Judge Sullivan has a well-earned reputation for fairness and disdain for government misconduct. He has now been presented by Powell with a literal mountain of evidence clearly documenting multiple instances of reprehensible misconduct on the part of the FBI, the Mueller team and the DOJ lawyers in this case, all in an effort to entrap, abuse, and persecute a man who has spent his entire adult life in stellar service to this country. Even worse, it is crystal clear that the thuggery deployed by the Mueller team was designed to force Flynn into offering dishonest testimony alleging misconduct by a duly-elected President of the United States.
The only people who deserve to be punished in this case are those who were and/or still are employed at the Department of Justice.
Judge Sullivan now has a prime opportunity to start righting all of the wrongs committed by these disloyal government officials against General Flynn.
Lets hope he does the right thing.
That is all.
Consider a few facts.
The case has only been ongoing for three years, not a decade.
For the first 23 months of the case, Flynn had lawyers who appear to have actively cooperated with the prosecution, without telling Flynn.
Powell has had the case 13 months.
Powell has done more for General Flynn in those 13 months, than his previous lawyers did in the previous two years. Much of what Powell has had to do, was undo the damage done by previous counsel.
National review Jan 29, 2020. in the filing about withdrawing his guikty plea, Flynn said the DOJ campaign including threatening his son. Also said his prior firm had conflict of interest. DOJ told prior firm to discuss with him, which they never did (FARA).
Precisely! Thank you for confirming.
Dan the judge throw out the entire case-—with Prejudice— on his own?
He certainly has seen enough bad faith on the part of the “FBI”.
I also do not understand WHY the FBI is still using ‘interviews followed up by written forms saying what the FBI agents think they heard’.
With the wide array of electronic audio & video available to interviewers, nothing should be ‘written after the interview is over’.

If a case is dismissed, it is usually for lack of evidence.
If a case is dismissed “with prejudice” it means that the case was so bad you could go after the accusing party for damages the allegation caused (usually legal expenses)
I am not a lawyer, I don’t even play one on TV... but I think that’s correct.
Sidney Powell? Lacks legal acumen? Well if I ever had to have a lawyer lacking “legal acumen” I’d hire her in a New York minute!!
This case should have been thrown out and the FBI individuals tried instead.
Wasn’t the problem or one of them, was he was lobbying for a truckish organization that was on the bad guys list? I haven’t followed this to closely. Flynn was trying to monetize his military experience. What did he actually end up pleading guilty too? His lawyers really did that how are they not in hot water and why did he pay them? Very screwy
Turkish, but maybe they were truckers too.
Give him a billion dollars.
And make the DOJ criminals pay it all back by making license plates.
Flynn did not know they were cooperating with the FBI on the Foreign Agents Registration Act.
Powell noted in Wednesday’s motion that Flynn’s former defense team at Covington & Burling, a well known Washington D.C. law firm, failed to inform Flynn that their lawyers had made “some initial errors or statements that were misunderstood in the FARA registration process and filings.” She also reaffirmed her position in the motion that government prosecutors are continuing to withhold exculpatory information that would benefit Flynn.“Government counsel specified Mr. Flynn’s liability for ‘false statements’ in the FARA registration, and he told Covington to discuss it with Mr. Flynn,” states the motion. “This etched the conflict in stone. Covington betrayed Mr. Flynn.”
Flynn has to get out of the current dilemma before he can go after them.
Flynn plead guilty to one count of lying to the FBI. Now he is attempting to retract that plea.
Dismissed with prejudice means that the case is dismissed permanently. Dismissed without prejudice means that the plaintiff (government, in this case) can file and bring the case again.
It that all that it means?
why would a case that was dismissed ever be brought back in?
I have had 2 cases dismissed. And neither one was ever brought back, and the prosecutor looked pissed.
