If what Democrats said was true, that they could do whatever they wanted given the Constitution supposedly granting them "sole power" on the grounds of impeachment, and this supposedly meant they could ignore the rest of the Constitution and act like dictators in the process, then where it also says the Senate has "sole power" for trial, McConnell and other Repubs in the Senate have equal power to Pelosi, Schifty, and Nadler, just different functions within this context.
So if Dems could call anyone they wanted to be interrogated, then Repubs can call anyone they want to be a witness. Even Pelosi, the "whistleblower," and Schifty (as Ken Starr was called). Dems may say that was under different rules then. But Dems did not go by the rules in 1998, nor 2015 rules, but made up their own rules - and so can McConnell; Repubs can make up rules as well.
They can do whatever they want. And if Schifty or Pelosi don't show up to testify then the Senate needs to hold them in contempt first, then retake the House and impeach them both.
If Dems can ignore Due Process Rights under US law based upon their interpretation of "sole power" for the House, then what can Republicans do with their "sole power" ("The Senate shall have sole power to try impeachments") in the Senate?
The Founders were worried a day may come when those lacking righteousness and virtue would abuse the power of impeachment. So it's either Dems get punched hard in the mouth (raw power vs. raw power) that they may learn to not be abusive, we severely restrict impeachment and trial power, America gets righteous and virtuous again, or we sadly may be headed for a civil war.
I remember the concern trolls here at FR who kept saying the Dems could do whatever they wanted with “sole power” of impeachment but what will they say given that Repubs have “sole power” for trial?
“The Senate shall have sole power to try all impeachments.”
The Senate has sole power not the Republican party.
To try is the key phrase here.
The Constitution does not say Must try. The Senate can adopt rules anyway they want to. They can decide they wont even try this at all. They can decide not to even hold a vote and simply dismiss it with prejudice. The Senate can hold hearings or call witnesses or do whatever they want.
And too bad for Nancy Pelosi, she cant do a thing about it.
I think Mitch will follow the rules from the Clinton trial. Hear the House case and call a vote to convict or acquit EOS. By following the rules for the American public to see, the GOP looks sane and Constutional. The insanity of the Dems is further displayed. Nasty loses period. Meanwhile the Dem senators are losing campaign time.
There was no impeachment in 2015 for there to be rules to follow.
But the House has control of impeachment, think of this as securing an indictment where the accused is innocent until proven guilty. This means President Trump has been impeached, with 2 articles of impeachment.
Senate on the other hand has sole power for the trial leading to either conviction, or acquittal.
It says “The House shall have sole power...”
Dems interpreted that to nmean Dems in the Senate.
Ergo, “The Senate shall have sole power” means then only Repubs in the Senate.
They get to do the same.
No, he needs to do whatever he wants. Some Dems, like children, only learn with a good spanking.
Repubs can do whatever they want.
When it says “The House had some power...” and Dems said that meant just them, then Repubs under “ The Senate shall have sole power...” means only Repubs in the Senate.
The House is like the prosecutor who secures a true bill from the grand jury, has a press conference displaying an indictment, then files the indictment in a desk drawer instead of in a court.
The accused is never arrested, and no trial takes place.
Has the acccused been indicted? Academic question. One can come down on either side. But it’s such an odd abuse of prosecutorial power that we simply haven’t developed a clear sense of how to answer.
Did you forget that Dems said they did not have to go by the House rule changes in 2015 regarding impeachments? Rule changes can be made even if no impeachment is currently taking place and rules were made in 2015. Keep up...
Dems went ahead with “The House shall have sole power...” and did what they wanted making whatever rules they desired so that means Repubs under “ The Senate shall have sole power...” get to do what they want.
Dems interpreted the House’s sole power to mean the Dems in the House received this power so Repubs with “The Senate shall have sole power...” get to say this gives power to Repubs in the Senate.
The intellectual issue with having the sole power over the trial is a bit like a judge having the sole power over a trial. Is there a trial when there is no prosecutor bringing the case?
The House power to impeach necessarily reaches into the trial process. The House is obliged to argue its case to the tribunal.
The sole power the senate has is setting the parameters of the trial, but the existence of a trial (both sides presenting arguments) depends on the House arguing its case.
Just saw the clip of pelosi being asked about prince harry..and she responds about tom brady. I dont think this is an edited clip. I think it is real..and hilarious
Why can we not find any Dems that live by “Manners maketh the man” and who live by a desire for civility and tranquility, but instead seem driven to upend all order?
Why does it seem they only learn with a swift kick to you know where?
The House rules are mute on the subject of impeachment. ZERO content on the subject.
The only current impeachment content in the House is resolutions adopted last year, specifically on the Trump case. All the other House rules EXPRESSLY deal with the power to legislate.
But needless to say when down the road a bit said person is acquitted are they now indicted any longer? If said person when acquitted, 10 years later, do people go around saying such and such was indicted? No, they talk about how they were acquitted. So why do people obsess over an impeachment once an acquittal takes place?
Dems said that an Impeachment is an indictment.
If so, when Trump is acquitted, how then can Dems say Trump is still impeached?
Yeah.
Seems to me the media has been careful to avoid that the Senate wants to treat the Trump impeachment like Clinton’s.
