Hawaii Lawmakers Want Congress To Weigh 2nd Amendment Repeal

A group of Hawaii state legislators wants Congress to repeal the right to bear arms — or at least specify that it is not an individual right. The resolution filed Tuesday in the Hawaiian Senate, SCR42, is backed by freshman state Sen. Stanley Chang, best known for defeating the chamber’s last Republican in 2016.

Chang’s measure, which has four co-sponsors, would request Washington discuss either scrapping the Second Amendment altogether or clarifying that it only applies to organizations such as state militias.

Chang, a Honolulu attorney who studied law under now-U.S. Sen. Elizabeth Warren, throws rocks at the U.S. Supreme Court’s 2008 Heller ruling that held the Second Amendment protected an individual right to arms.

“(U)nder this ‘individual right theory’, the United States Constitution restricts legislative bodies from prohibiting firearm possession, or at the very least, the Second Amendment renders prohibitory and restrictive regulation presumptively unconstitutional,” notes the measure.

Hawaii has some of the strongest gun control regulations in the country, requiring the registration of all firearms, capping magazine capacity for handguns at 10 rounds, and mandating a permit to purchase a gun. The state issues so few concealed carry permits that local police chiefs have been repeatedly hauled into federal court to defend their “may issue” practices, with mixed results. Likewise, ost NFA-regulated firearms and suppressors are prohibited for the average Hawaiian.

And after that happens, Hawaiian police will meet all flights at the airport and ships at ports and send anyone back to wherever they came from to keep the Hawaiian crime rate low and keep welfare roles at a minimum.

I have a perfect solution for Hawaii - secede and let China pick them up in a hot flash. Guaranteed not a single gun on the islands in private hands after that. Go for it, Hawaii

If it comes to it, I’d rather have the 2nd Amendment than have Hawaii as a state. Couldn’t Congress repeal the law admitting Hawaii as a state? Or even repeal the taking possession of Hawaii from the Republic?

The 2nd amendment to the constitution does not give Americans the right to bear arms.

It is a natural right.

The 2nd amendment merely reminds the federal government and the states that Americans have that right.

Remove the amendment, and the right remains. This is essentially the same natural right a person has to defend himself against someone trying to hurt them (or their property).

There would be plenty of Americans who would be willing to turn in their arms, but there are also plenty who would not be so willing.

It doesn’t matter. The right to bear arms doesn’t come from the 2nd Ammendment or any Supreme Court ruling. It is a natural right of the people declared by the 2nd Ammendment. The Bill of Rights was written to tell the government what it cannot take.

Yes, I think this is a good idea.

Introduce an Amendment to repeal II.

Make it so, if it passes both Houses of Congress but fails of ratification, it can’t be brought up again for 100 years.
