Million Plus NJ Gun Owners Defy State Law, Refuse to Turn Over Banned Gun Mags

Over one million New Jersey Gun owners defy Governor Murphy's gun magazine ban & turn in demands of what some estimate is easily more than ten million now illegal standard capacity gun mags.


New Jersey –-(Ammoland.com)- New Jersey's standard capacity magazine ban is now in effect making New Jersey's one million gun owners criminals in the eyes of the state. But in an act of mass definace, New Jersey residents refuse to comply.

Any magazine holding more than ten rounds is now illegal in the Garden State. The standard magazine for an AR-15 holds 30 rounds. Glock 19s, which is the most popular pistol in the United States, holds 15 rounds. Anyone who is possession of larger magazine is committing a fourth-degree felony.

Anyone caught with one of the now banned magazines in their possession faces up to 18 months in prison and up to $10,000 in fines or both for each magazine found.

The bill was signed into law last June by Gov. Phil Murphy (D). Residents had until December 11th, 2018, to turn over magazines to police or sell or store them out of state.

Pro-gun groups sued New Jersey to try to prevent the law from going into effect. Their attempt on blocking the law failed in a federal appeals court. The three-judge panel ruled that a law limiting the number of rounds a magazine holds did not violate the US Constitution and did not put an undue burden on New Jersey gun owners.

“New Jersey’s law reasonably fits the State’s interest in public safety and does not unconstitutionally burden the Second Amendment’s right to self-defense in the home,” the court wrote in their decision.

The right protected by the Second Amendment is "to keep and bear arms." "Arms" comprises the entire firearm, including the magazine.

If the Gestapo can arbitrarily restrict the capacity of the magazine to 10 rounds, it can restrict it to 9. Or 8. Or 5. Or to a single shot. No more magazine-fed firearms at all.

Continually restricting the aspects of a firearm -- magazines, ammunition, parts -- or enacting burdensome taxes, is de facto denial of the Second Amendment. It's the coward's way of sneaking in the back door.

Or the undercover LEO could arrest the possessor on the spot.

Selective enforcement of the law is the easiest way to cow the peasants.

You are seeing a million conservative voters becoming criminals. I guess it is true, if you make guns illegal only criminals will have guns. Stroke of a pen and a million new criminals, kinda cool.

Sounds like the Dem plan is working as hoped.

What a tragedy it will be for some unfortunate man or woman in that state totally unaware of the new legislation.
They will think they are visiting the range to have fun and will find themselves heading to prison for a few years missing thousands of dollars.

Just as the concept that law abiding citizens should not fall prey to non-law abiding ones when it comes to weather or not concealed carry should be allowed, neither should the non-law abiding be able to have more ammunition capacity than the law-abiding citizen. And, magazines are not accessories, they are essential to the functionality of a semi-automatic firearm.

Dana Loesch covered this very unfortunate New Jersey legislation.
Age of manufacture is of no impact.
If one has a Beretta, Glock, or SIG from 1998 (for example) with 12-round magazines, that person is still a felon.

So if anything over 10-rounds are prohibited, most police agencies are violating the law. Since the Sig P-226 is a favorite among agencies and they come standard with a 15-round mag.

I hope the legislature has allocated the funding to replace these mags since the law goes by potential capacity and not what is in the mag.

Sounds like what our department did when they upgraded to .357’s back in the 70’s. People complained so they made us carry .38spl in the Smith’s. Did that for years until we upgraded to semi-auto’s...Sig P226 9mm w/ 15-round mags.

The law exempts department-issued weapons and magazines but NOT LEO privately owned weapons and magazines. And as I doubt most LEOs only have department-issued weapons and magazines, they are all violating the laws they are tasked to enforce. Thus, if there is to be any enforcement, start with them first!

Your memory is most likely inaccurate since the SCOTUS rarely announces the reasons why it refuses to take a case. Sometimes the reasons have nothing to do with the merits of the case; sometimes the concern is that case could produce a bad precedent. Indeed, if I recall correctly, the NY Safe Act case, if cert had been granted, would have gone to the SCOTUS after Scalia's death, but before the appointment of his replacement, and in all likelihood, the Court would have voted 4 to 4 to affirm the lower court decision, and effectively bar challenges to the Safe Act at a future date.
