TX: Knife Preemption to Governor Abbott, Decriminalizatin of Knives "double-crossed" by Whitmire

Good and bad news for Texas knife law reform.  The good news is that HB 905 is headed to Governor Abbott's desk.  If only one knife reform bill is to pass this session, this is the preferred one.   The bad news is that knife decriminalization seems to have been killed.

In a spot of good news, HB 905 (knife preemption) is on its way to Governor Abbott. Unfortunately, HB 3884 (decriminalization of "illegal" knives) was killed after Senator Whitmire double-crossed us. He agreed to sponsor HB 3884 and hear it in his committee, in order to get one of his own bills out of the author's (Rep. Harold Dutton) committee.

Then, after passing the bill out of committee (on unanimous vote) and recommending it for the Local and Uncontested Calendar, he pulled it down. 
I have not  been able to confirm the comment by Bladed, but he has been a very reliable source.   I know that HB 905 was on the "Local & Uncontested" calendar, and that HB 3884 had not been listed there.

I suspect that it is too late in the session to resurrect HB 3884, which was probably Senator Whitmire's strategy.

Senator Whitmire (D) has been a state senator for over 30 years. He was a state representative (D) for 10 years before that. Of his 66 years on earth, he has been in the Texas State government for 44 years. He is in a safe district in Houston.

Didn’t I also read somewhere that “LICENSED” open carry was up for signature? LICENSED? WTH! Might as well add registered to it as well. Come on TX.

An open carry bill was passed yesterday and the Governor will sign it. Texas has a CHL (Concealed Handgun License) program, and the new law will change so that for CHL holders can open carry.

It is not Constitutional Carry, but it is a step in the right direction. We will keep pressing for non infringed keeping and bearing of arms, but we was glad to win this battle.

Useless but interesting factoid:

Switchblades are illegal in Kalifornia, unless.........
you only have one arm!

Nice factoid. I’m surprised they didn’t make switchblades illegal unless ...you only have one arm AND NO TEETH.

Nice piece of workmanship!

In the 80’s, when i lived in SoCal, I carried my old USAF
Pilot’s Survival knife on my belt, since the blade is less
than six inches in length.

RKBA does not mean, or limited to firearms, only.

You’re right about what you read. If you open carry or concealed carry you will still need a license. Long guns and rifles are unrestricted. Until Strauss is gone along with a few other RINO’s, it won’t change. Maybe in 2017, but I don’t plan on holding my breath.

The Air Force Survival knife is reported to have a 5” blade. Therefore it is legal to carry in Texas.

False.

PC653, PC12020 and PC17235 make no mention of it.

Much of California has no limits on blade length however.
Depends what County or City.

I can’t find a reference to it either. Darn, it sounded so “California” logical.

But after wading into all the nuances of CA knife laws, it became obvious that it is very easy to violate the law. Ludicrously complicated. And probably riddled with contradictions.

The state legislature is nothing more than an upscale insane asylum.

OK, so I went back to figure this out & now I know where I got that assumption.

My daughter used to be with SFPD. I got the info from her, but I slightly misunderstood. So, when I asked her again she said that they were told that if a person had one arm or one hand or the use of only one, that a knife violation of this sort was to be ignored (unless that person was a genuine threat of some sort). She said she didn’t know whether that meant the prosecutors didn’t want to mess with it, or that her superiors didn’t.
