When I go to my local Chinese takeout and I ask for an extra packet of soy sauce and the guy at the desk (not the owner) puts several in my brown paper bag, should he be fired?
When I worked for McDonalds, at closing we had to throw away 15-20 lb trash bags of food. Closers were not allowed to take any home or risk being fired.
My husband runs a restaurant and he thinks the management was complete overkill. And his restaurant is a hellava lot better than the awful Cracker Barrel.
If Mickey D’s gave it to a shelter and somebody got sick they’d get sued.
Well, of course they’d get sued. That’s the problem with insane regulations that force good people to throw out decent food that can be given to homeless shelters or even an animal shelter. The destruction of good food by restaurants in this country is a national embarrassment.
God save us all from your twisted version of compassion.
It said he’d been written up 5 times. I wouldn’t have waited for 5 if I’d been the manager. They must have liked him as a server to give him so many chances.

Without a doubt.
I do understand the legal liability but that doesn’t mitigate the loss of good food when people need it. I guess it is a protection mechanism by the restaurants. I get it.
I do wonder if Cracker Barrel has a food allowance provision for their employees. That dastardly muffin could have been part of his daily allowance.
Maybe we aren’t getting the full story.
Perhaps he only gave the homeless guy a stump.
Cracker Barrel margins (~4.4%) are lower than Walmart margins. Except unlike Walmart, they have fewer units over which they can defray their expenses. Attracting hoboes into an eating establishment does have the unfortunate effect of turning off paying customers.
Just where are all these hoboes that everyone keeps talking about? You know, the ones lining up for the mayonnaise. Most Cracker Barrels as far as I know (and please correct me if I’m wrong) are out on highways, freeways, turnpikes, etc. I can generally see those nauseating billboards driving long distances. This is not generally the area where homeless people congregate.
The guy got in trouble for taking a sip of Coke! 30 lashes with a wet noodle as Ann Landers used to say. Most of these fast food joints are complete skinflints when it comes to even giving an employee a drink of water. They give you those tiny, collapsible paper cups that fill about a thimble full of water. It’s impossible to wash down the mayonnaise on that small a quantity.

He is probably doing what he was told by the management, and that is why the packets are there. You bought the meal from the restaurant and are a paying customer. What you are comparing is not even remotely similar to what this fellow did.
I own my own business, and if my employees see fit to give away MY product, services or supplies, they have to pay me for them, or they will be fired for stealing.
Politicians generously give free stuff that isn’t theirs to win votes from people that don’t understand or care that anything given away for free had to be taken away from someone else.
If a person wants to be charitable, he needs to use his own resources, be it time, money, property, etc.
A business can’t keep employees who get caught with their hands in the till.
It would depend on what his employer has instructed him to do.
