Baker Must Make Cake for Same Sex Marriage in State Where Same Sex Marriage is Illegal
Creative Minority Report ^ | May 31, 2014 | Matthew Archbold

Posted on 05/31/2014 2:51:34 PM PDT by NYer

Same-sex marriage is still illegal in Colorado but the state's civil rights commission ruled Friday that Jack Phillips has to bake a cake for a same-sex marriage ceremony.

The Daily Caller reports:

In 2012, Jack Phillips, who owns Masterpiece Cakes in Lakewood, refused to sell cakes to Dave Mullins and Charlie Craig, a same-sex couple. Mullin and Craig were to be married in Massachusetts but wanted a cake for a reception at their home in a Denver suburb.

As he had done with other same-sex couples in the past Phillips refused to sell the goods, saying that he is a devout Christian and doesn’t approve of same-sex marriage.

With the help of the American Civil Liberties Union, Mullins and Craig sued Phillips citing the state’s Anti-Discrimination Act. It bars businesses from refusing service based on race, sex or sexual orientation. Though gay marriage is still illegal in Colorado, the commission cited the act in its ruling.

“I can believe anything I want, but if I’m going to do business here, I’d ought to not discriminate against people,” Commissioner Raju Jaram said, according to the Colorado Springs Gazette.
It hardly makes sense. A state where same-sex marriage is illegal is forcing a baker to provide cake for a same-sex marriage. Legality has nothing to do with this. This is thuggery. Thuggery with lawyers.

Just make a white cake. Don’t ask what it’s for. Let them decorate it the way they want. Or, just say they don’t bake wedding cakes. It’s not profitable.

Go ahead and make the cake. If it’s chocolate, fill it full of Ex-Lax.

As mentioned in a related thread, the right not to do business with someone is acknowledged in the Constitution.

From a related thread ...

Note the following constitutional acknowledgement of the right not to do business with someone. The Constitution’s Clause 17 of Section 8 of Article I gives a state’s legislature the power to not consent to do business, deciding not to sell state property to the feds in that example.

From the Constitution's Clause 17 of Section 8 of Article I:"

”… and to exercise like Authority over all Places purchased by the Consent [emphasis added] of the Legislature of the State in which the Same shall be, …”

So there is constitutional grounds for the right not to do business with someone.

Also, note that Clause 17 doesn't require a state to have reason not to do business. And not doing business in the name of 1st Amendment-protected religious expression is certainly as honorable under the Constitution as having no reason.

But what do the feds do when a state won’t consent to sell them some property? Does the Union then cease to exist? No! The feds just find a state willing to sell them property so that the feds can stimulate the economy of a state willing to do business with them by investing federal tax dollars in an Article I, Section 8-justifiable, multi-billion dollar military installation for example.

Likewise, I'm sure that competing bakers will appreciate the extra business from the Christian baker expressing his faith.

Exactly. I could be his friend. ~Pay for his supplies, and I have expensive taste.

Who would be able to say how much I pay for supplies?

Are the bolsheviks going to check each and every cake he bakes for friends and compute the costs?

We have to be much much smarter to work around what’s happening in this world. Russians worked around the USSR system, they had to. We need to do the same.

We are told to be as mild as doves and as wise as serpents.

We can stand, but we have to do it in such a way to confound the system.

“Gawd. IN previous generations, people who made up such insane rules would have been taken to a lunatic asylum to be cared for.”

Naw, in previous generations, these people would have been dealt with. The litigants and their attorneys. Nothing would have been said, it would have just been taken care of.

What about the sign for businesses: 'We reserve the right to serve anyone.'?

Business owners should have the right to refuse business.

I go onto gay sites about this subject and find that the gay guys are very leery about eating these cakes and are advising their cohorts to find other gay men to make their cakes. These are not bright guys. Mean, yes, just not bright.

Appeal. Slavery is unconstitutional. A business should have a right to refuse service to anyone for any reason. However, I can see a middle ground which would prevent a grocery store, for example, from refusing service. It is packaged goods which requires no personal input to complete the transaction. However, this isn’t, it requires (and this decision apparently compels) an artistic input.

And should appeals fail, continue on refusing such business, refusing to pay any fines for decisions based upon that, etc. You just can’t give in.

I’ll tell you one thing, those “openly gay” homosexuals sure do eat a lot of cake. They get really pissed at people who won’t bake them one.

““When I use a word,’ Humpty Dumpty said in rather a scornful tone, ‘it means just what I choose it to mean — neither more nor less.’

’The question is,’ said Alice, ‘whether you can make words mean so many different things.’

’The question is,’ said Humpty Dumpty, ‘which is to be master — that’s all.”

Lewis Carroll

Our country has endorsed the Humpty-Dumpty Rule.

Laws are interpreted by whoever gains the upper hand.

Forcing someone to bake a cake is tantamount to slavery.

silverleaf posted a brilliant suggestion on a related theread:
Their cake designs are so beautiful!

I hope instead of “wedding cakes” they decide to make “Genesis cakes”, with this verse in the design

Genesis 1:27-28 So God created man in his own image, in the image of God he created him; male and female he created them. And God blessed them. And God said to them, “Be fruitful and multiply and fill the earth and subdue it and have dominion over the fish of the sea and over the birds of the heavens and over every living thing that moves on the earth.”

Anyone who chooses to buy a Genesis cake design should be freely served

30 posted on 5/31/2014, 10:19:56 AM by silverleaf

I'm sorry, due to a court order, we no longer make wedding cakes, could I interest you in a Genesis Cake?...

Although I would have gone with the KJV: God blessed them, and God said unto them, Be fruitful, and multiply, and replenish the earth

You could then be liable for damaging the wedding party. Your little prank could end up costing you thousands of dollars.

The simple solution, in my book, is to have a prominent sign saying that all proceeds from cakes baked for homosexual events will be given to pro-family causes.
