Sheriff Arrested in Florida Defending the Second Amendment

A number of Sheriffs around the country have pledged to abide by the Second Amendment and not enforce laws that they believe violate the Constitution.

Sixty-seven sheriffs in Florida signed one of those pledges declaring that they would uphold the Second Amendment and protect people’s’ right to keep and bear arms.

One of those signatories, Sheriff Nicholas Finch, was arrested by Governor Rick Scott in Florida for actions he took in a case in early March in which Finch made his stand for the Second Amendment.

Carl Causey has been appointed to replace him by Governor Scott until July when the case will be heard.

The charge stems from an incident involving his Deputy Sheriff, James Hoagland.

On March 8, Sgt. James Hoagland arrested a man named Floyd Parrish who was carrying a concealing semi-automatic, fully loaded. As Parrish was being booked, one jail worker said Finch came in with a Parrish family member and spoke with Parrish. Finch then took possession of Parrish’s arrest file and released Parrish and his gun.

Several days later, Hoagland asked Finch about it and Finch said he believed in “Second Amendment rights.”

Court records showed that Parrish’s name was whited-out from the county jail log. Hoagland did have a copy of the arrest record but the original record is missing.

Mr. Finch was arrested on a Third-Degree Felony charge of official misconduct for destroying or removing official documents from the county jail to cover up the arrest of Mr. Parrish. Finch was released on his own recognizance.

No more than it would have been “within his discretion” as Sheriff, if the man was arrested for something like DUI, spousal or child abuse, arson, rape or simple assault.

Actually, quite a bit more within his discretion. There was no victim in this supposed crime. Nor does there appear to have been any intended victim. Nor does there appear to have been anyone at risk.

This is precisely the type of crimes, where sheriffs exercise a great deal of discretion.

They don’t have to arrest you. I knew a cop in North Carolina back in the early 70s. He caught a college student carrying a .25 auto concealed in his back pocket at a bus stop.

Not wanting to basically ruin his life, he unloaded it, kept the cartridges and gave the gun back to him.

I once talked to a Florida Highway Patrolman (He was my Sunday School Teacher) who said if he caught a motorist illegally carrying a gun, he just would tell the the legal way and let him go. that is if he wasn’t doing any thing else illegal.

It sounds to me like this deputy was maybe illegally searching the guy. He was carrying a large revolver in a holster which is perfectly legal in Florida. Since that is legal it should not have resulted in a search. My bet is he used the fact that he was carrying a legal gun as an excuse to search. In my opinion that is improper.

"Today, Governor Rick Scott announced the appointment of Carl Causey as Interim Sheriff of Liberty County.

Causey, 53, of Gulf Breeze, has been the Assistant Special Agent in Charge for the Pensacola Region of the Florida Department of Law Enforcement since 2010. Previously, ASAC Causey served 11 years with the Escambia County Sheriff’s Office where he worked in patrol and investigations. Causey served as an agent in the Sebring Field Office of the Florida Department of Law Enforcement from 1993 to 1996, and as an agent in the Pensacola Regional Operations Center from 1996 to 2007. In 2007, he was promoted to Special Agent Supervisor over the Major Crimes Squad. He received his bachelor’s degree in criminal justice from Troy State University.

Governor Scott said, “I am confident that Carl Causey will serve the families of Liberty County well during this interim term.”

Causey replaces suspended Liberty County Sheriff Nick Finch, and is appointed for a term beginning June 4, 2013, and ending July 4, 2013.

knarf, thank you for the Causey bio. He has a long LE background, certainly.

I have heard some serious criticisms of the FDLE from time to time, also.

What kind of guy is Causey, really? I will give him he benefit of the doubt for now, but time will tell us more . . . ..

In any case, it is a bit ironic all this is happening in a juridiction known as “Liberty” County.
