A number of Sheriffs around the country have pledged to abide by the Second Amendment and not enforce laws that they believe violate the Constitution.
Sixty-seven sheriffs in Florida signed one of those pledges declaring that they would uphold the Second Amendment and protect peoples right to keep and bear arms.
One of those signatories, Sheriff Nicholas Finch, was arrested by Governor Rick Scott in Florida for actions he took in a case in early March in which Finch made his stand for the Second Amendment.
Carl Causey has been appointed to replace him by Governor Scott until July when the case will be heard.
The charge stems from an incident involving his Deputy Sheriff, James Hoagland.
On March 8, Sgt. James Hoagland arrested a man named Floyd Parrish who was carrying a concealing semi-automatic, fully loaded. As Parrish was being booked, one jail worker said Finch came in with a Parrish family member and spoke with Parrish. Finch then took possession of Parrishs arrest file and released Parrish and his gun.
Several days later, Hoagland asked Finch about it and Finch said he believed in Second Amendment rights.
Court records showed that Parrishs name was whited-out from the county jail log. Hoagland did have a copy of the arrest record but the original record is missing.
Mr. Finch was arrested on a Third-Degree Felony charge of official misconduct for destroying or removing official documents from the county jail to cover up the arrest of Mr. Parrish. Finch was released on his own recognizance.

Is there some other reason for the arrest? I was under the impression that concealed carry was legal in Florida.

It is alleged that he then altered or destroyed paperwork relating to the arrest.
The story posted here a day or two ago says that the sheriff let the guy go and whited out his name in the arrest book, so he would not have the arrest used against him.
I think the charge was that the sheriff tampered with the records.
What bothers me is that the Republican Governor, Rick Scott, is once again doing Obama’s work, as he did in the skittles case.
It’s legal only with a shall issue permit. Looks like the original arestee didn’t have one. Really no substantial reason not to arrest that man.
If you read the arrest warrant, the sheriff moved to release the prisoner ROR, which is his prerogative. But then he expunged the record of the arrest and incarceration, which is beyond his authority.
There is no reason given for the original search that found the concealed weapon. A little more information would be helpful. Was it a bad search and the sheriff wanted to avoid a lawsuit of the overeager deputy? Lots of possibilities. The slant of the article may be deduced from the fact that the writer chose to describe the concealed weapon as "semi-automatic fully loaded" to make it sound more dangerous.
The leftist are going nuts, because they expected to have all guns outlawed by now. They can't get control of the population of they if they are able to defend themselves. People need to wake up. Maybe the surveillance leaks opened some eyes.
Not so much in this case. He is the Sheriff, one assumes that he is then the Deputy's boss, no? Whether an arrest is made or not for such offenses is at the discretion of the police/sheriff. So, does the Sheriff run his department or not? If he ripped up the arrest paperwork and released the man before he was brought to the prosecutor, then what is the case?
I'd say its pretty clearly a case of being within the discretion of his office.
Unless you believe in the 2A, and that since the man wasn't in the commission of crime that actually harmed anyone, it was a non-issue.
Doing bad things with a gun should be illegal, possessing one, concealed or not, should never be for a free citizen.
Obama chooses not enforce hundreds of laws, how is this Sheriff any different?
He appointed an interim Sheriff while the matter is being investigated.
I live in Florida, and I do not have a CCW permit.
I could easily legally obtain one, if I desired one, but I do not currently have one, and if I am ever “caught” with a concealed gun by a cop...I am going to be arrested and processed for a concealed weapon violation.
Since I do not carry any concealed weapons that require a special legal permit, it is not a problem for me, as I am a law abiding citizen.
I do not believe that any of the the State laws that require citizens to acquire a concealed weapons permit are just, but it is a legal State of Florida law, not a federal one, and I am willing to work to persuade my neighbors and elected politicians to think as I do, and repeal those laws, and state that we Floridians can carry whatever weapons we want, as long as we do not use any of them to commit a crime against another person.
I do not know the mechanism in Liberty County to expunge an illegal/false arrest from the records, but I very much doubt applying “whiteout” on the official arrest form is one of them...

No, it was not “within his discretion” to rip up the arresting officers paperwork for the violation.
No more than it would have been “within his discretion” as Sheriff, if the man was arrested for something like DUI, spousal or child abuse, arson, rape or simple assault.
