I disagree. The fourth amendment is to keep police/officials in check; or are you of the opinion that the Bill of Rights is [primarily] NOT about property-rights?
60% of the Bill of rights deals DIRECTLY with property-rights; take the 3rd amendment for example, it was adopted because when the crown forced the colonists to house soldiers frequently “things would turn up missing” or the ladies would be molested.
The 4th was a DIRECT response to the practice of Agents of the Crown authorizing Carte Blanche warrants allowing the lawmen or soldiers to go on “fishing expeditions” to find evidence of guilt.
The 5th Amendment places a check against rampant prosecutions by REQUIRING *ALL* ‘capital, or otherwise infamous crime[s]’ (excepting Army/Navy/Militia during war/public-danger) to go through the Grand Jury.
The 6th Amendment is written the way it is:
1) Ensuring a speedy trial; so that you can’t be held held & held until somebody, somewhere, decides to hear your case. {If time is money, then how much money is stolen by ‘detentions.’}
2) A public trial; so that the public can see [and ensure] that Justice is being done.
3) By a JURY! (Not some Congressional panel, or a collection of LEOs...)
4) “AND TO BE INFORMED OF THE NATURE AND CAUSE OF THE ACCUSATION” — So that you aren’t either held until something can be found AND so you know what’s going on.
5) “to be confronted with the witnesses against him” — So that there are NO “secret sources say you’re a traitor...” type trials.
6) To allow someone to call witnesses in their own favor; YOU ARE NOT TO BE RENDERED INCAPABLE OF DEFENSE.
AND
7) To have an adviser/expert on the law.
Amendment 7 prohibits the government from arbitrarily deciding civil cases when the value is greater than $20.
Amendment 8 prohibits excessive fines; or would you rather live in “Oh, you were jaywalking... that’s a $2,000 fine!”-land?

Here’s the deal, when you are in customs containment or point of immigration, you are not considered in the country, technically.
Besides, they are smartass Canadians who think they are more egalitarian than dumb Americans.
Honestly, I get your point but, that is a point of immigration and it is just not cool, in any country, ever.

Now if you are trying to find equivalence with LEO’s against Americans, that doesn’t work but, I would agree with you if that was the subject here.
Bottom line is the guy is a Canadian Tool and he should have just cooperated. Now he is going to get interviewed a little harder than he would have every time he crosses.

Um, and who are you, or they, to determine any of those cases? Are they trained to diagnose such? Are such illegal? Moreover, is there sufficient cause to think that they would be a harm to Citizens?
Also, this is again SOME reason; remember you are defending “No Reason.”
In response to the rest of your post, the Canadian smart ass, now has the opportunity to avail himself of Constitutional protections.
He didn’t need to put himself in the position of being arrested and then he wouldn’t need to worry about Constitutional provisions.
If they guy isn’t an American, I don’t actually care about his problems.

Unless of course he is the decoy to pull attention away from the other bad guy trying to cross the border. Believe it or not but some bad guys can think multidimensionally.
All the more reason not to waste the time of 3 agents on a Canadian with an attitude. (But I see your point - he could actually be aiding and abetting.)

I would assume so. The guy was probably waiting a pretty long time and so they would have to edit it for length before posting it on youtube.

I had a very interesting border crossing recently. I was driving a friend of mine who had to pick up supplies inside Canada and we went across at Sumas. When we came back across, even though the supplies we had with us were listed on a certain type of paper which we thought was right because a Customs Broker had been called...Long story, but we tried to cross back into the USA at Sumas and they said we didn’t have the right paperwork and needed to drive to Blaine where there were Customs Brokers who were open. We did not know the name of the correct broker and my friend’s Canadian partner was off playing bridge and had his phone turned off.
When we got to Blaine we had to park our vehicle on the Canadian side, walk to the US side and report, then around and around in the dark, walking from Canada to USA looking for the broker. It was a huge mess. We did luck out and find the right broker but it took us hours.
When we finally got our papers in order and were back at the USA side, a young CBP agent said he would show us outside where to go to get our vehicle xrayed. When we were halfway there he turned to me with a twinkle in his eye and said something like “Well, you got your one-time exemption....unless you LIED.” I looked at the twinkle and I took my right hand and unconciously whacked him on his arm. And then I KNEW. I had just assaulted an OFFICER! I told him I didn’t mean it and he said he had expected me to do it actually.
When I gave the xray guy our papers he told us to go over and sit on a bench and then come back in and pay our fine. I could not imagine what kind of fine this could be, since we had already paid our fees for the supplies.
When I went back after the vehicle was xrayed the CBP guy said we were free to go. He said he would waive the fine, even though we were the ones who had ASSAULTED the officer, RIGHT? He had been teasing us as well. He knew we had been there for about 7 hours going round and round in no man’s land trying to get home. My friend had just had major surgery, which is why I was driving her on her errand. She probably thinks I’m a true nut.
I can laugh about it now but it sure was stupid of me to let myself whack the guy like that!
Anyway, my observation of the border is that lately if you are bringing back commercial goods they want any extra excise tax badly to help fund the Obama BIG Gov.
He was a douche bag. Just the tone of his voice should have gotten him strip searched.
The last time I went through was particularly harrowing. I have to mention that I have a border card that "pre clears" me for US travel, something like a "trusted traveller" card. It is issued by the US government and they have prints and photos of me. They were pre-inspecting cars before you reached the booths, it was either an exercise or they had some kind of intelligence they were acting on. The car in front of me was given particular scrutiny, trunk searched, and then the officer walked the car over for secondary inspection. When my turn finally came, I held my card up to the reader and proceeded to the booth. As I held my ID card out the window the conversation went like this:
Me: "Hello"
Officer: Staring at his computer screen, not taking my ID: "What is your last name?
Me: "FPC" (I was able to answer correctly without hesitation)
Officer: "Is this your car?
Me: "Yes"
Officer: "Have a nice day"
Me: "You too."
You have to realize that, when you cross the border you are attempting to enter another country. They can ask you anything they want and search you without any cause. You have to govern yourself accordingly and things will usually work out. There is no advantage to mouthing off to these guys, they have all the cards and you are at their mercy. That's just how it is.
For every Canadian who gets hassled at the border there is a story of an American getting the business coming into Canada. It happens.
Border Patrol does not need to establish probable cause to detain anyone.Follow their instructions to the letter.They can rip your car apart and don't even have to leave you with a wrench, duct tape and a screwdriver.
You don't like it? Tough.
We are at war.
What I want to know is why the Southern border is not as strict!
I cross the Canadian border once a month on average. I have never had a problem beause I have good manners and always answer their questions truthfully to the very best of my ability.Put yourselves in their shoes ,protecting the border and conversing with hundreds of people on an 8 hour shift, where anyone of them might have a bomb in the trunk.
Kudos to the border patrol!
This Canadian on the tape doesn't know squat.If he didn't know the store he was going to , he could have said , "I don't know," and left it at that.
